Present Reese Davis & Edward Dawvell(?) - Justice of said court County of Monroe Missouri An instrument of wrighting purporting to be the Last will of John McKainey dec'd was produced in Court and proven by the oaths of Phillip Williams and G M Br__er two of the subscribing witnesses thereto and ordered to be recorded. The bond of Margaret McKanvey, Robert McKaney, James H. Smith and William K ____dall as executor of the Estate of John McKawey Deceased with Wesley Hill and James Pogue as their securitites in the final sum of six thousand dollars was submitted to the Court and approved and ordered to be intered on ____ and it is further ordered that the clerk of said Court grant letters to said Executors in vacation. County Court May Term AD 1835 Now at this day came William K.Van___dall one of the executors of the estate of John McKinney deceased and eshibited to this Court the first annual settlement of the estate of the said deceased and the Court having entirely examined the same with the vouchers and find it to be correct therefore the same is approved of b the Court and ordered to be entered of record in settlement book as required by law and therefore the executors of said estate is discharged from making my further settlements as executors as aforesaid until the February Term of said Court 1836. ----------------------------------------------------------------------------- Page 4 County Court Held Dec 23, 1833, Adjourned Term Margaret McKamey, James H. Smith and William K. Vana__dall thereof the executors of John McKamey dec'd personally approved in open court and produced and Inventory of the estate of said deceased whereupon the foregoing executors qualified in open court to said inventory and it is ordered that the same be filed. County Court May Term 1836 On motion of William K. Vanarsdall Co executors of the estate of John McKamey deceased it is ordered by the Court that said exr. of said deceased be and they are hereby exhonorated from making their second annual settlement of said estate. County Court August Term 1837 Now at this day came William K Vanarsdall one of the executors of John McKamey deceased and submitted to the court his final settlement of the estate of said deceased which was seen by the court and inspected with the vouchers and found to be correct and approved of and ordered to be entered of record and the executors of said deceased is exhonorated from making any further settlement of said estate. ----------------------------------------------------------------------------- Page 5 County Court Oct 5th 1857 Be it remembered that a paper or instrument of writing purporting to be the last will of Pleasant M Burgess was this day presented to the Court for probate and thereupon personally appeared in open Court George Gleene and William A Penn the subscribing witnesses to said will being by me of the Court first duly sworn the said George Glenn deposes and says that the said Pleasant M Burgess the Testator subscribed the same in his presence and published the said will or instrument of writing as his last will and the said W A Penn deposes and says that the said Pleasant M Burgess the Testator either subscribed the same in his presence or declared that he had subscribed the same and published the said will or instrument of writing as his last will and each of said deponents further depose that the said P M Burgess the Testator was at the time of publishing his last said will of sound mind and more than twenty one years of age and that they the said deponents attested said will as witness thereto by subscribing their names to the same in the presence of said Testator and at this request which proof is deemed by the Court sufficient to establish said Will. In vacation Monroe County Court October 17th1857 On motion of Robert M Burgess who entered into and executed Bond to the state of Missouri in the Sum of twenty four thousand dollars with Wesley Wilson and Marcus Poage and Sanford Wilson as securities, Letters testamentary are granted him on the estate of Pleasant M Burgess deceased and Joseph H Fox and Levi Shortridge named as witnesses to assist in opening and examining the money books and papers of said deceased and making an inventory thereof as required by law. Attest W N Penn clerk Monroe County Court November 4th 1857 The Bond of Robert M Burgess as executor of Pleasant M Burgess deceased which was taken by the clerk of this Court in vacation was this day examined and approved and ordered to be filed. ----------------------------------------------------------------------------- Page 6 County Court Dec 7th 1857 Wills & Burnett Plaintiff Against } Exhibition of a demand Robert M Burgess Executor of the last Will of Pleasant M Burgess deceased Defendant Now at this day came as well one of the Plaintiffs as the said Executor and the necessity of a written motion being waived and the account being sworn to and proven in open Court the same is by the Court allowed in the 5th class of debts against said Estate for twelve dollars and eighty cents and all costs hereon expended. W E Spalding Plaintiff Against } Exhibition of a demand Robert M Burgess Executor of the last will of Pleasant M Burgess deceased Defendant Now at this day come as the well the Plaintiff by his agent as the said Executor and the necessity of a written motion being waived and the account being sworn to and proven in open court the same as by the court allowed in the 3d class of debts against said estate for twenty dollars and all cost herein expanded. Hendricks & Co. Plaintiffs Against } Exhibition of a demand Robert M Burgess Executor of the last Will of Pleasant M Burgess deceased Defendant Plaintiff Now at this day comes as well the Plaintiff as the said executor and the neccessity of a written motion being waived and the account being sworn to and proven in open court the same is by the Court allowed in the 5th class of debts against said Estate for eighty six dollars and eighty cents of all costs herein expended.
