Perry County, Missouri Wills - Thomas Riney 7 April 1856 - 3 March 1859 Copy of the last will of Thomas RINEY, deceased. In the name of God, Amen. I Thomas RINEY of Perry Co., Missouri, of sound and disposing mind, memory and understanding do make publish and declare this my last will and testament, in manner and form following. After my death I desire that my body be buried in a decent Christian manner; after payment of my funeral expenses and all my just debts I dispose of my property as follows: 1st I will and bequeath to my grandchildren the children of my daughter Nancy deceased, wife of Martin I. MOORE; to the children of my daughter Polly, deceased, wife of Mark D. MANNING; to the children of my daughter, Lucinda, deceased, wife of Augustine LAYTON; to the children of my daughter, Lucretia, deceased, wife of James HAGAN, one hundred dollars to each sett of the four above setts of heirs in full of said grandchildren share in my estate. 2nd I will and bequeath unto the children of my son, Evarestus, to include William RINEY, his son by his first wife, the sum of five dollars and also a negro boy named Joe, son of Melinda in full of their share in my estates. 3rd I will and bequeath unto my son, Simon RINEY, the sum of three hundred dollars in full of his share in my estate. 4th I will and bequeath unto Levinia, wife of Bernard CISSELL, the sum of three hundred dollars in full of her share in my estate. 5th I will and bequeath unto Emily, wife of Edward M. TUCKER, the sum of three hundred dollars in full of her share in my estate. 6th I will and bequeath unto Sarah Ann the sum of three hundred dollars in full of her share in my estate. 7th I will and bequeath unto my son, Sevarius RINEY, the sum of one dollar in full of his share in my estate. 8th I will and bequeath unto my son, Thomas E. RINEY, the sum of one dollar in full of his share in my estate. 9th I will and bequeath unto my beloved wife, Sarah, lots no. 4 and 5 (as subdivided and laid off into lots and numbered for my convenience containing one hundred and ninety acres each, lying in survey 1844, township No. 36, north, Range No. 10 E and also lot No. 10 in same township and range containing thirty-nine acres more or less; also 6 negros, to wit. Mary, Melinda, Jim, Henry, Moses and Joe together with all the remainder of my property both personal and real, all money due and owing to me which I hereby authorize my wife to collect; all of the above property I will and bequeath unto my said wife, Sarah, absolutely to dispose of as she may choose to do. ) Lastly, I constitute and appoint my son, Thomas E. RINEY, and Peter DEAN, to execute this my last will and testament hereby revoking all former will or wills made by me. BURNS, clerk of the county court within and for the county of Perry in the state of Missouri (in Vacation) There came Robert M. BREWER one of the subscribing witnesses to the within last will and testament of Thomas RINEY late of Perry County deceased, who being duly sworn by me doth depose and say that he did see the said Thomas RINEY sign the within and foregoing instrument of writing by making his mark thereto. (The testators name being written thereto by this deponent as his request.) And that he the said Thomas RINEY did publish and declare said instrument of writing to be his last will and testament in presence of this deponent and of Gregory BREWER, the other subscribing witness thereto; that at the time of signing and publishing the same the said Thomas RINEY was of sound mind and above the age of twenty-one years and that this deponent and the said Gregory BREWER both subscribed our names to said will as witnesses at the request and in the presence of the testator and in the presence of each other on the day of the date of said will, to wit. BURNS, clerk of the county court, within and for the county of Perry in the State of Missouri (in Vacation) there came Gregory BREWER one of the subscribing witnesses to the within last will and testament of Thomas RINEY late of Perry County, deceased, and the said Gregory BREWER being by me duly sworn, deposeth and sayeth that he saw the within named testator Thomas RINEY sign the within and foregoing instrument of writing by making his mark thereto (the testator name being written thereto by Robert M. BREWER the other subscribing witness at his request) And that the said Thomas RINEY did publish and declare said instrument of writing, to be his last will and testament in presence of this deponent and of Robert M. BREWER the other subscribing witness thereto; that at the time of signing and publishing the same the said Thomas RINEY was of sound mind and above the age of twenty -one years and that this deponent and the said Robert M. BREWER both subscribed our names to said will as witnesses at the request and in the presence of the Testator and in the presence of each other on the day of the date of said will, to wit: On the 7th day of April A. D. 1859 before the undersigned clerk of the county court within and for the county aforesaid, personally appeared John BREWER, who being by me duly sworn deposeth and sayeth that he is well acquainted with the handwriting of Gregory BREWER, from having often seen him write and from his knowledge of the handwriting of said Gregory BREWER thus acquired the deponent believes the signature of Gregory BREWER to the annexed and foregoing instrument of writing purporting to be the last will of Thomas RINEY deceased as a subscribing witness thereto is in the proper handwriting and is the genuine signature of the said Gregory BREWER sworn to and subscribed John BREWER, sworn and subscribed before me this 3rd day of March A. On May the 7th 1859 being the 6th day of the regular May term 1859 of said county court of Perry County, the following Entry appears of record at page 310 of Vol. 7 of the records of said county court in rel. to the probate of the last will and testament of the said Thomas RINEY, deceased. The clerk presents an instrument of writing purporting to be the last will and testament of Thomas RINEY, deceased: the probate thereof is taken in due form of law by the clerk of this court in vacation. On the 3rd day of March A. D. 1859 is now submitted to the court for approval and conformity therein the court orders that said probate of said last will and testament so taken in vacation by the clerk of this court be and the same is hereby confirmed to all intents and purposes and declared as valid as if it were proven before the court in Term time and said instrument is fully established as the last will and testament of said RINEY deceased.
