Mangus of the County of Saline in the State of Missouri, party of the first part, John Johnson of the Same County & State aforesaid party of the second part, and Abigail Johnson of the Same County & State aforesaid party of the third part, WITNESSETH, that the said party of the first part, in consideration of the debt and trust hereinafter mentioned and created, and of the sum on one dollar to him paid by the said party of the second part, the receipt of which is hereby acknowledges, do by these presents, grant, bargain and sell, convey and confirm, unto the said party of the second part, the following described tract or parcel of land, situated in the County of Saline, in the State of Missouri, to wit: Thirty acres more or less off the North West quarter of the South West quarter of Section Number nineteen ??? Township fifty-one Range nineteen subject to having ten acres taken off the East side of the same piece of land. TO HAVE AND TO HOLD the same, with the appurtenances, to the said party of the second part, and to his successor hereinafter designated, and to the assigns of him and of his successor forever. IN TRUST, HOWEVER, for the following purposes: whereas, The Said William F. Mangus has executed and delivered to the Said Johnson his promissory note in word and figures as follows to wit: May 25th 1871 $150 Five years and Six months after date. I promise to pay Abigail Johnson one hundred and fifty dollars value received to bear interest at the rate of ten percent per annum after the fifteenth day of Nov. 1871. And if the interest is not paid annually it is to become as principal and bear the same rate of interest. Signed W. F. Mangus as has also agreed with said third party endorsees and also agrees, to cause all taxes and assessments, general and special, to be paid whenever imposed upon said property and within the time required by law. Now if said note & full interest thereon be paid when the same become due and payable, then this Deed shall be void, and the property hereinbefore conveyed shall be released at the cost of the said party of the first part but if default be made in the payment of said note or all or any interest thereon when the same become due and payable according to the true term date & effect hereof. Or in the faithful performance of said agreement for paying taxes, &c., as aforesaid, then this deed shall remain in force, and the said party of the second part, or in case of his death, to act, or absence from said State when authorized to sell under these presents, and a sale be desired by the holder of said note, then the Sheriff of Saline County, for the time being, who shall thereupon become his successor to the title of said property, and the same become vested in him, in trust for the purposes and objects of these presents, and with all the powers, duties and obligation thereof, may proceed to sell the property hereinbefore described, or any part thereof, at public vendue, to the highest bidder, at Marshall Saline County Missouri. Seventy days public notice of the time, terms and place of sale, and of the property to be sold, by advertisement in some newspaper published in the State of Missouri and upon such sale shall execute and deliver a deed in fee simple of the property sold, to the purchaser or purchasers thereof (a recital wherein of the giving of such notice and in case such Sheriff as aforesaid sell, of the happening of any or either of the aforesaid events, making him successor herein, as aforesaid, shall be proof thereof) and receive the proceeds of said sale, out of which he shall pay, first, the costs and expenses of this trusts, including compensation to the trustee for his services, and next, whatever may be in arrear and unpaid on the note aforesaid, whether of principal or interest, and the remainder, if any, shall be paid to the said party of the first part or to his legal representatives, and the said part in the second part covenant and faithfully to perform and fulfill the trust herein created. Stamp STATE OF MISSOURI COUNTY OF SALINE BE IT REMEMBERED, that on this 25th day of May eighteen hundred and seventy one, before me, the undersigned Justice of the Peace within and for the County & State aforesaid came W. F. Mangus and Susan his wife who are personally known to me to be the same person whose names are subscribed to the foregoing instrument of writing as parties thereto, and they acknowledge the same to be their act and deed for the purposes therein mentioned. And She the said Susan his wife having been by me first made acquainted with the contents of said instrument of writing, acknowledged, on an examination part from her husband, that she executed the same, freely, and without compulsion or undue influence of her said husband.
