Hale December 29th 1884 State of Missouri, County of Stoddard In the name of God Amen. I James L. Hale of the County and State aforesaid being of sound mind and disposing memory but being conscious of the uncertainty of life and the certainty of death and being desirous of making a proper disposition of my worldly goods do make constitute and publish this as my last will and testament. 1st I desire that all my just debts be paid out of my Effects that my body be decently buried. 2nd I give and bequeath to my daughter Mary E. Kerby five Dollars. 3rd I give and bequeath to my daughter Caroline E. Price five dollars. 4th I give and bequeath to my son Mathew R. Hale five dollars. 5th I give and bequeath to my daughter Mahala A. Higgins Five dollars 6th I give and bequeath to my daughter Emma E. Whitlidge Five Dollars. 7th I give and bequeath to my son William T. Hale five dollars. 8th I give and bequeath to my daughter Sarah E. Hale Five dollars and it is my will that these several amounts be paid to my said children out of any money that may be on hand at the time of my death over and above the necessary burial expenses. But should there be none on hand then I desire that my Executor should sell a sufficient amount of personal property of my Estate to pay the same. In the next place I give and bequeath to my beloved wife Anna Hale should she be living at the time of my death all my remaining property of every kind and description both real and personal during her natural life or widowhood and should my said wife marry again then and in that event it is my will that all of said property given to my said wife as aforesaid shall be equally divided among my said children. Except forty acres of land known and described as follows to wit The South West quarter of the North West quarter of section Twenty (20) Township Twenty Six (26) Range (11) which I give and bequeath to my daughter Sarah E. Hale she not having received as much as my other children in the way of advancements at the death or marriage of my wife Anna Hale. I desire that all the remaining portion of my Real Estate Except the pg. 128 Forty acres give to my daughter Sarah E. Hale above be Equally divided among all my children also all the personal property of every kind and discription. I further will and desire that in the Event that either of my children should die without issue that the property given to them by this will be equally divided among the remaining children. In witness whereof I have hereunto set my hand and affixed my Seal. James L. Hale State of Missouri, County of Stoddard December 29th 1884 We Stephen Chapman and Charles H. Barham do hereby certify that James L. Hale who is personally known to us to be the same person whose name is signed to the foregoing instrument signed the same in our presence and acknowledged the same to be his act and deed for the purposes therein maintained. Stephen Chapman Charles H. Barham Proff of Will State of Missouri, County of Stoddard In the Probate Court Be it Remembered that on this the 16th day of May A.D. 1887 before me W. R. McCarroll Clerk of the probate Court held in and for the county and State aforesaid, personally appeared Stephen Chapman and Chas. H. Barham, who are the subscribing witnesses to the annexed will of James L. Hale deceased and being by me first duly sworn depose and say That the said James L. Hale the Testator subscribed the same in their presence and published and declared said will or Instrument of writing to be his last will and testament and that at the time of signing the same he the said testator was of sound and disposing mind and more than twenty one years of age, and that said deponent attested said will as witness thereto by subscribing their name at the request of the said testator. Wilson Judge of the Probate court of Stoddard County State of Missouri having Examined the foregoing Instrument purporting to be the Last Will of James L. Hale deceased and having heard the testimony of Stephen Chapman and Charles H. Barham subscribing witnesses thereto in Relation to the Execution of the same do declare and adjudge said Instrument to be the Last Will and testament of the said James L. Hale deceased late of Stoddard County, Missouri. In Testimony whereof I have hereunto set my hand and affixed the seal of said court at office in Bloomfield this 16th day of May A.D. 1887 P.G.
