I David Lewis of the County of Stoddard and State of Missouri aged 82 years being of sound mind do make and publish my last will and Testament which is as follows: 1st I request that all my just debts including my funeral expenses by paid by my executor herein after appointed out of my personal property and if not sufficient then out of my rel Estate That I have at the time of my death. 2nd I give and bequeath to my wife Elizabeth Lewis all of my property real, personal and mixed of any description after my debts and funeral expenses have been paid during her life. After the death of my wife Elizabeth Lewis I request that my property real personal and mixed be divided between my children and Grand Children as follows: To my daughter Susan Ann Evans One 5th of all my property real and personal that is not disposed of at the death of my wife. I give to my daughter Nancy R. Bobbed one fifth part of all my property both real and personal at the death of my wife. I give and bequeath to James S. Mager, William Mager, Lowell Barham, Lelia Zelsson and Winnie Barham children of Ester Barham my deceased daughter One fifth of all my property both Real and personal not disposed of at the death of my wife to be equally divided between them. I give and bequeath to Levi Lewis, Elizabeth Layton and Rhoda ... and heirs if any of Benford Lewis deceased, heirs of my son James Lewis deceased one fifth of all my real and personal property un-disposed of at the death of my wife to be equally divided between them. I give and bequeath to William Lewis and Albert Lewis children of my son David deceased one fifth of all my property both real and mixed un-disposed of at the death of my wife to be equally divided between them. The Real Estate Owned by me at this time is described as follows to wit: W/2 at W/4 Sec 2 Twp 26 R10 and E/2 SE SE/4 sec 2 Twp 26 Range 10 in Stoddard County Mo. 100 acres. I hereby appoint James Y. Evans Executor of this my last will and testament hereby revoking all former wills by me made. In testimony whereof I have hereunto subscribed my name this the 30th September 1805. David Lewis pg. 198 The foregoing instrument was at the time hereof signed and declared by the said David Lewis to be his last will and testament in the presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto. John M. Walker H. Story Proof of Will State of Missouri, County of Stoddard In the Probate Court Be it Remembered that on this the 29th day of December A.D. 1897 before me D. Wilcox Clerk of the probate Court held in and for the county and State aforesaid, personally appeared John M. Walker and H. Story who are the subscribing witnesses to the annexed will of David Lewis deceased, and being by me first duly sworn depose and say That the said David Lewis the Testator subscribed the same in their presence and published and declared said will or Instrument of writing to be his last will and testament and that at the time of signing the same he the said testator was of sound and disposing mind and more than twenty-one years of age, and that said deponents attested said will as witnesses thereto by subscribing their names to the same in the presence of the Testator and of each other and at the request of the said testator. Wilcox Clerk of the Probate court of Stoddard County State of Missouri having Examined the foregoing Instrument purporting to be the Last Will of David Lewis deceased and having heard the testimony of John M. Walker and H. Story subscribing witnesses thereto in Relation of the Execution of the same, do declare and adjudge said Instrument to be the Last Will of David Lewis deceased late of Stoddard County, Missouri.
