I give and bequeath to my two sons jointly Charles and James, all my property real and personall of every description Subject to the following legacies; To my four daughters now at home Alice, Cara, Berthie and Ellia each a horse and cow or its value in money. My other daughters Mary wife of J.N. Miller, and Emma, wife of F.M. Ladd and Addie, wife of Geo. W. Seilert have each had the same, that is a horse and cow. I make this Will to my two sons with the understanding that they take care of and support myself and their mother during our lives. I hereby appoint my two sons Charles and James my executors. In Witness whereof, I have hereunto set my hand this Dec 15th 1888. Deason Proof of Will State of Missouri, County of Stoddard In the Probate Court Be it Remembered, that on this the 12th day of January A.D. 1899 before me Thomas Connelly, Judge of the Probate Court, held in and for the county and State aforesaid, personally appeared M. Deason, who are the subscribing witnesses to the annexed will of John Sitton deceased, and being by me first duly sworn, depose and say That the said John Sitton the Testator, subscribed the same in their presence, and published and declared said will or Instrument of writing to be his last will and testament, and that at the time of signing the same the said testator was of sound and disposing mind, and more than twenty-one years of age, and that said deponent attested said pg. 213 will as witnesses thereto, by subscribing my name to the same in the presence of the Testator, and of each other, and at the request of the said testator and that the other witness, Geo. N. Boughton, is either dead or his whereabouts unknown. M. Deason Sworn to and Subscribed before me this 11th day of January A.D. 1899. Thomas Connelly Judge of Probate Certificate of Probate of Will State of Missouri, County of Stoddard In the Probate Court in vacation Jan 12th 1899 I Thomas Connelly Judge of the Probate court of Stoddard County, Missouri, having Examined the foregoing Instrument of date Dec 15th 1888, purporting to be the Last Will and testament of John Sitton, deceased, late of Stoddard County and having heard the testimony of M. Deason, and proof of signature of Geo. N. Boughton (dead or whereabouts unknown) subscribing witnesses thereto, in Relation of the Execution of the same, do declare and adjudge said Instrument of date Dec. 15, 1888, is the Last Will and testament of said John Sitton deceased, and the same is therefore admitted to Probate. In testimony whereof I have hereunto set my hand and affixed the seal of said court at office this 12th day of January 1899. Ladd as Sureties, are held and firmly bound unto the State of Missouri in the sum of Six Hundred Dollars, for the payment of which we do hereby bond ourselves, our heirs, Executors and administrators firmly by these presents. Sealed with our seals and dated at Dexter in the State aforesaid, this 4th day of February A.D. 1899. Pg. 214 The condition of the above bond is, that the said James Sitton and Charles Sitton Executors of the Last Will and testament of John Sitton deceased, last of Stoddard County, Missouri, shall well and faithfully execute the said Last Will and testament, and shall make true and faithful inventories, returns and settlements of accounts of the Estate of the said Testator, according to law, and shall, moreover, do and perform all other matters and things touching the execution of the said Last Will and testament as are or shall be prescribed by law, or enjoined on them by the order, sentence or decree of any court having competent jurisdiction, then this obligation to be void and of no effect; otherwise to remain in full force. Sitton as executors of the Estate of John Sitton be filed and approved. Thomas Connelly Judge of Probate Oath State of Missouri County of Stoddard The undersigned, James Sitton and Chas W. Sitton Executors of the last will and Testament of John Sitton deceased, late of Stoddard County, Missouri personally appeared before me, a notary Public for Stoddard county State of Missouri, and being duly sworn by me, upon oath says that they will make a true and perfect Inventory of all and singular the goods and chattels, lands, and tenements rights and credits of the said Testator, according to law, and will well and truly execute or administer the last Will and Testament pg. 215 of the said Testator, by paying first his debts, and then the legacies contained in said Last will and testament, as far as the assets of the said Testator will extend and the law direct, under just accounts and faithfully perform all things required by law touching such Executorship or Administration. Walker Clerk Letters Testamentary State of Missouri, County of Stoddard To All to whom these presents shall come, -- Greeting: Know ye, that the last Will and Testament of John Sitton deceased, late of Stoddard county, Missouri, hath in due form of law, been Exhibited proved, and recorded, in the office of the Clerk of the Probate Court of Stoddard county, Missouri, a copy of which is hereunto annexed and inasmuch as it appears that James Sitton and Charley Sitton have been appointed Executors in and by the said Last Will and testament to execute the same and to the end that the property of the said Testator may be presented for those who shall appear to have a legal right or interest therein and that the said last Will and Testament may be Executed according to the request and instruction of the said Testator we do hereby authorize them the said James Sitton and Charley Sitton as such Executors to collect and secure all and singular the goods and chattels rights and credits, which were of the said John Sitton at the time of his death whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon them by said Last Will and testament so far as then shall be property and the law charges them; and on general to do pg. 216 perform all other acts which are now or may be hereafter required of them by law.
