Knowing the uncertainty of life and the certainty of death and being desirous to make a final disposition of what property I may have at my death, Hereby make and declare this to be may last Will and testament; (as follows to wit) First after my death; It is my will that all my just debts Funeral expenses be paid. 2ndly I will and bequeath all my property both real personal & mixed to my beloved son Henderson Story. Except as herein after stated. The real estate hereby bequeathed being East half of the North East quarter of Section Number thirty five, The south part of the South east quarter of the south West quarter, The South West part of the North West quarter of the South East quarter, and the North west Part of the south West quarter of the South East quarter of Section twenty six all in Township Twenty seven North of Range No. Two East. One hundred twenty acres more or less. 3rdly I give and bequeath my son Huston Story One dollar to be paid to him by my executor hereinafter named. 4thly to my son Jefferson B. Story one dollar to be paid by my Executor. 5thly to my Daughter Naomi Walker, One dollar to be paid to her by my executor. 6thly to my Daughter Calfumy Jones one dollar to be given to her by my Executor. 7thly to my daughter Nancy Story one dollar to be paid to her by my Executor. 8thly And I hereby will & bequeath to my daughter Elizabeth Walker one dollar to be paid to her by my Executor. It is my will and desire that my Executor, hereinafter named pay these several sums to my said children as herein above stated, out of any money he may have of my Estate. 9thly I hereby make, constitute and appoint my pg. 238 said son Henderson Story My executor to execute this my last Will & Testament. Bedford and John K. Cunningham, who are the subscribing witnesses to the annexed will of Lemuel Story deceased, and being by me first duly sworn depose and say That the said Lemuel Story the Testator, subscribed the same in their presence, and published and declared said will or Instrument of writing to be his last will and testament and that at the time of signing the same he, the said testator was of sound and disposing mind, and more than twenty-one years of age, and that said deponents attested said will as witnesses thereto, by subscribing their names to the same in the presence of the Testator and of each other and at the request of the said testator. Cunningham who being by me first duly sworn, on his oath state that he was one of the subscribing witnesses, to the annexed, Last Will and Testament of Lemuel Story, deceased. Connelly , Judge of the Probate court of Stoddard County, Missouri, having Examined the foregoing Instrument of date _______, purporting to be the Last Will and testament of Lemuel Story, deceased, and signed by said Lemuel Story, deceased, late of Stoddard County and having heard the testimony of H.H. Bedford and J.K. Cunningham, subscribing witnesses thereto, in Relation of the Execution of the same, do declare and adjudge said Instrument of date ________ Is the Last Will and testament of said Lemuel Story deceased and the same is therefore admitted to Probate. In testimony whereof I have hereunto set my hand and affixed the seal of said court at office this 2nd day of January 1900. Thos. Allen, Clerk of Probate Executors Bonds, or Bond of Administrator with Will Annexed We, Henderson Story, as Principal, and ________as securities, are held and firmly bound unto the State of Missouri, in the Sum of One thousand dollars, for the payment of which we do hereby bind ourselves, our heirs, executors and administrators firmly by these presents. Sealed with our seals and dated at Bloomfield Mo., in the sate aforesaid, this second day of January A.D. 1900. The condition of the above Bond is that if the said Henderson Story, Executor of the last will and Testament of Lemuel Story, deceased, late of Stoddard County, Missouri shall well and pg. 241 faithfully execute the said Last Will and Testament, and shall make true and faithful Inventories returns and settlements of accounts of the Estate of said Testator, according to law and shall moreover do and perform all other matters and things touching the execution of the said Last Will and testament, as one or shall be prescribed by law, or enjoined on him by the order, sentence or decree of any court having competent jurisdiction, then this obligation to be void and of no effect; otherwise to remain in full force. Allen, Clerk of Probate Letter Testamentary State of Missouri County of Stoddard To all to whom these presents shall come - Greeting: Know ye, that the last will and testament of Lemuel Story, deceased, late of Stoddard County, Missouri, hath in due form of law been exhibited, proved and recorded, in the office of the Judge of the Probate Court of Stoddard County, Missouri, a copy of which is hereto annexed; and inasmuch as it appears that Henderson Story has been appointed Executor in pg. 242 and by said Last Will and Testament to execute the same, and to the end that the property of the said Testator may be presented for those who shall appear to have a legal right or interest therein and then the said Last Will and testament May be executed according to the request and instruction of the said Testator, we do hereby authorize him the said Henderson Story, as such Executor, to collect and secure all and singular, the good and chattels, rights and credits, which were of the said Lemuel Story at the time of his death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon him by said Last will and Testament so far as there shall be property and the law charge him; and in general to do and perform all other acts which are now or may be hereafter required of him by law.
