I John Cawthon of the County of Stoddard in the State of Missouri, being in a very infirm State of health and at the same time being according to my own apprentions of Sound Mind and anxious to make a Suitable disposition of my Real and personal estate do make ordain and declare this my last will and testament, hereby revoking all others. It is my will that all My just debts and the charges of My funeral Expenses be paid by Executor herein after named and appointed out of my Estate as Soon as Conveniently may be after My decease. After all my just debts and funeral expenses are paid I give to my beloved wife Margaret Cawthon all My personal property, Moneys and Credits, my land or Real Estate, that She May have the means to support and educate our children, as long as She remains a widow. I give My land or Real Estate with the Exception of a certain tract I.E. West half of lot number Seven of the N E quarter, and the East half of lot No. Seven of the N West quarter of Section One in township twenty Seven North of Range Ten East, containing one hundred and fifteen acres forty one hundredths of an acre, which I wish to be sold for the payment of my Just debts. To My children whose names are as follows (To Wit) Sarah E. Lockard, Charles Claiborne Cawthon, John F. Cawthon, John W. Cawthon, William R. Cawthon and Mary G. Cawthon and that I declare the same to be My legal heirs, and I desire that they share alike deducting what has been given to the Elder children, in the afore named Real Estate or on the proceeds of Said Land when sold, and furthermore, I give to my beloved wife Margaret Cawthon the controll and use of the Farm on which I now live during her widowhood. pg. 25 And I furthermore give to My Son John F. Cawthon all my carpenter tools and appendances. I hereby appoint James G. Nall Executor of this My last Will and testament. In testimony whereof I have hereto Subscribed My Name and affixed My Seal this 8th day of January AD 1869. John Cawton - signed We attested the within and foregoing will by Subscribing our Names hereto as witnesses in the presence of John Cawthon the Testator this 8th day of January AD 1869. Jesse B. Legget W.W. Sanders State of Missouri, County of Stoddard In vacation of the County Court, Be it remembered that on this 16th day of February 1869 personally appeared before the undersigned Adrian B. Owen Clerk of the county court of the county and State aforesaid, Jesse B. Legget and W.W. Sanders the Subscribing witnesses to the annexed will of John Cawthon. And being by me first duly Sworn, the said Jesse B. Legget and W.W. Sanders deposes and says that the said John Cawthon the testator Subscribed the same in their presence and published the said will or instrument of writing as his last will; and he the Said testator, was at the time of publishing his said Will of sound mind and more than twenty one years of age, and that they the said deponents attested to the Said will as witnesses unto by subscribing their names to the Same in the presence of said testator.
