June the 3 1897 I Elijah Jenkins of the vilage of Tilmen, county of Stoddard and State of Missouri being of sound mind and memory do make publish and declair this to be my last Will and testament to wit First. All my just debts and funeral expences shal be first fully paid Second. I give devise and bequeath all my property both real and personal too my too daughters M.A. Spears, Dianah Richmond and the heirs of my son J.H. Jenkins deceased, E.B. Jenkins, William Jenkins, J.D. Jenkins, Jack Jenkins, Sarah Jenkins being the heirs of my son J.H. Jenkins deceased. Third I give devise and bequeath one dollar too my friend J.W. Garner to have and to hold to him my said friend and to his heirs and assigns forever. To be divided as follows to wit First one third to M.A. Spears Second one third to Dianah Richmond Third one third to E.B. Jenkins, William Jenkins, J.H. Jenkins, Jack Jenkins and Lorah Jenkins being the heirs of my son J.H. Jenkins, deceased. Fourth after paying my friend J.W. Garner one dollar as his legacy I also further desire said property shall be divided by said heirs provided they shall ... in said division otherwise to be done by arbitrative said arbitrators to be selected by said heirs. Fifth I nominate and appoint L.W. Spears husband of my daughter M.A. Spears to be the executor of my last will and Testament. Sixth I also nominate and appoint M.E. Jenkins Guardian for the minor heirs of J.H. Jenkins deceased. Connelly Judge of Probate Proof of Will State of Missouri, County of Stoddard In the Probate Court Be it Remembered, that on this the 9th day of August A.D. 1900 before me, Thomas Connelly, Judge of probate Court, held in and for the county and State aforesaid, personally appeared Wm. Bollinger and R.B. Overby, who are the subscribing witnesses to the annexed will of Elijah Jenkins deceased, and being by me first duly sworn depose and say That the said Elijah Jenkins the Testator, subscribed the same in their presence, and published and declared said will or Instrument of writing to be his last will and testament and that at the time of signing the same he, the said testator was of sound and disposing mind, and more than twenty-one years of age, and that said deponents attested said will as witnesses thereto, by subscribing their names to the same in the presence of the Testator and of each other and at the request of the said testator. Connelly , Judge of the Probate court of Stoddard County, Missouri, having Examined the foregoing Instrument of date June 3", 1900, purporting to be the Last Will and testament of Elijah Jenkins, deceased and signed by said Elijah Jenkins deceased, late of Stoddard County Missouri and having heard the testimony of Wm. Bollinger and R.B. Overbey, subscribing witnesses thereto, in Relation of the Execution of the same, do declare and adjudge said Instrument of date Jun 3" 1897 is the Last Will and testament of said Elijah Jenkins deceased, and the same is therefore admitted to probate. In testimony whereof I have hereunto set my hand and affixed the seal of said court at office this 9"day of August 1900. Thos. Connelly Probate Judge Letters Testamentary State of Missouri County of Stoddard To all to whom these presents shall come - Greeting: Know ye, that the last will and testament of Elijah Jenkins, deceased, late of Stoddard County, Missouri, hath in due form of law been exhibited, proved and recorded, in the office of the Judge of the Probate Court of Stoddard County, Missouri, a copy of which is hereunto annexed; and inasmuch as it appears that Leemon W. Spears has been appointed Executor in and by said Last Will and Testament to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein and that the said Last Will and testament May be executed according to the request and instruction of the Testator, we do hereby authorize him the said Leemon W. Pg. 265 Spears as such Executor, to collect and secure all and singular, the goods and chattels, rights and credits, which were of the said Elijah Jenkins at the time of his death, in whosoever hands or possession the same may be found, and to perform and fulfill all such duties as may be enjoined upon him by said Last will and Testament so far as there shall be property, and the law charges him; and in general to do and perform all other acts which are now are or may be hereafter required of him by law. In Testimony whereof I Thos. Connelly, Judge of the Probate Court in and for said County of Stoddard hereunto signed my name and affixed the seal for the said court at office in Bloomfield, this 9" day of August, A.D. 1900.
