I Burl Phillips of the county of Stoddard in the State of Missouri being in a very infirm state of health and at the same time being according to my own apprehension of sound mind and anxious to make a suitable disposition of my real and personal estate do make ordain and declare this my last will and testament hereby revoking all others. It is my will that all my Just debts and the charges of my funeral expenses be paid by my executor hereinafter named and appointed out of my estate as soon as convenient may be after my decease after all my just debts and funeral charges are paid. I give to my beloved wife Susan Phillips all my real and personal estate to have and to hold her natural life or widowhood and at her death or marriage I give to my legal heirs their names as follows, William P. Phillips, George W. Phillips, Martha Phillips, Mary Phillips, Fanny Phillips all equal shears. I also will that my executor have power to sell after my decease my real estate and Envest the same in land where my beloved wife may chuse and at her my wife Susan Phillips death or marriage all my personal and real estate to be equal divided between my children herein before mentioned. I also will to Stephen Phillips and Amanda C. Phillips all my real estate three hundred acres of land lying and being in the State of Tennessee Weakley County equal between them heretofore conveyed to them. I hereby appoint Lampson Keysaw my executor of my last will and testament in witness whereof I have subscribed my name and affixed my seal this fifteenth day of January 1866. Burl S. Pirtle Pg. 29 State of Missouri, County of Stoddard Be it remembered that on this 5th day of December in the year of our Lord one thousand eight hundred and Sixty nine before me Caleb B. Crumb Judge of Probate within and for the County of Stoddard personally appeared Jefferson N. Stafford who being by me duly sworn upon his oath deposeth and says that he was present and saw Burrill Phillips exhibit the foregoing instrument purporting to be the last will and testament of his the said Burrill Phillips and heard him publish and declare the same to be his last will and testament and that at the time of exhibiting the same to us: to wit on the fifth day of November AD 1869 the said Burril Phillips was of sound and disposing mind and that this deponent and John Pirtle the other attesting witness subscribed their names thereto as witnesses to the same in the presence of the testator and of each other at the request of the said Burrel Phillips and in the presents of said Burrel Phillips at the same time this appointed changed the name of the person mentioned in said Will from Josiah For... Crumb Judge of Probate within and for the county of Stoddard personally appeared to John T. Pirtle who being by me duly sworn form his oath deposeth and says he was present and saw Burel Phillips sign the foregoing instrument purporting to be the last will and testament of him the said Burel Phillips and heard him publish and declare the same to be his last will and testament and that at the time of signing his name the said Burel Phillips was of sound and disposing mind and that this deponent and Jefferson R. Stafford the other attesting witness subscribed their names thereto as witnesses to the same in the presence of the testator and of each other and at the request of the said Burel Phillips. John J. Crumb Judge of Probate of Stoddard County having examined the foregoing instrument of Writing purporting to be the last will of and signed by Burel Phillips and the testimony of Jefferson R. Stafford and John T. Pirtle the witnesses above named do adjudge and declare the said instrument of writing to be the last will and testament of Burel Phillips deceased. In testimony whereof I have hereunto set my hand and affixed the seal of said Probate Court of Stoddard County at office in Bloomfield in said County this 10th day of December in the year of our Lord one thousand eight hundred and sixty nine.
