I John C. Miller of the county of Stoddard State of Missouri Being weak in body but of Sound mind do make and publish this my last will and Testament To Wit: First I give and bequeath to my beloved wife Mahalia all my property Real or personal during his life or or as long as she remains Single to use and dispose of as she thinks best for herself and children. If my wife Mahalia should marry I want my property real and personal to be divided equally among my children. Andrew Jackson, John Newton, Sarah Elizabeth, William, & George Washington. I constitute and appoint as the executors of this my last will and testament Calvin Riddle & Andrew Jackson Miller. In testimony whereof I have hereunto subscribed pg. 34 my hand and affixed my seal this 16th day of February eighteen hundred & sixty six. John C. Miller - signed Signed in the presence of the testator and at his request who declared the above to be his last will & testament in the presence of each other. Wm. C. Ladd J.D. Smith William McFarlen State of Missouri, County of Stoddard Be it remembered that on this 26th day of November in the year of our Lord one thousand eight hundred and seventy before me Caleb B. Crumb Judge of Probate within and for the county of Stoddard personally appeared William McFarlen who being by me duly sworn upon his oath deposeth and says that he was present on the 26th day of February Ad 1866 and saw John C. Miller write his name to and sign the foregoing instrument purporting to be the last will and testament of him the said John C. Miller and heard him publish and declare the same to be his last will and Testament and at that time the said John C. Miller was of sound and disposing mind and that William C. Ladd, John D. Smith and this deponent subscribed their names thereto as witnesses to the same in the presents of the testator and of each other and at the request of the said John C. Miller that said Ladd & Smith are dead. Willaim McFarlen Subscribed and sworn to before me this 26th day of November 1870. C.B. Crumb Judge of Probate County of Stoddard, I Caleb B. Crumb Judge of the probate Court of Stoddard County having examined the foregoing instrument of writing purporting to be the last will and testament of and signed by John C. Miller and the testimony of William McFarlen the only remaining witness above named; do adjudge and declare the said instrument of writing to be the last will and testament of John C. Miller deceased. In Testimony whereof I have hereunto set my hand and affixed the seal of said Probate court of Stoddard county at office in said County this 26th day of November in the year of our Lord one thousand eight hundred and seventy.
