Spence of the county of Stoddard and State of Missouri Being weak in Boddy but of Sound Mind do make and publish this my last will and testament To Wit First after my decease it is my will that all my Just debts be paid as hereinafter provided. Second, it is my will that my land be equally divided between my two children (To Wit) Peter M. and Anna E. Spence. Third, it is my will that my personal property be disposed of in the following manner. Fourth, it is my will that Anna E. have all the cows and sheep and Anna to have all in the house except one bed and beding and one clock and Peter M. and Anna divide the hogs. Fifth, it is my will that Peter M. my Son have my oxen wagon horse and all my farming Tools one bed and bedding and one clock and Peter to pay all my debts that May be unpaid. Sixth, it is my will that David and Mary Vaughn have twenty five dollars to there part. Seventh, it is my will that Henry Clark have twenty five dollars. Eighth, it is my will that Katharine A. Spence my grand daughter have five dollars when She is twenty one years of age, Ninth, it is my will that Martha E. Spence my grand daughter have one bed. Pg. 37 Tenth, it is my will that John A. Spence my grandson have five dollars at twenty one years of age. Eleventh, it is my will that Peter M. Spence and Anna E. Spence take care of and raise Martha E. and John A. Spence and school them the best they can. I Constitute and appoint as the executor of this my last will and testament Carter T. Welborn. In testimony whereof I have hereunto Subscribed my hand and affixed my Seal this 28th day of January AD 1871. Hiram Culbertson Samuel Culbertson State of Missouri, county of Stoddard Be it remembered that on this the 25th day of March AD 1871 before me Stephen Chapman Clerk of the Probate Court within and for the County of Stoddard in the State of Missouri personally appeared Hiram Culbertson and Samuel Culbertson who being by me duly sworn upon their oath say that they were present and saw John J. Spence Sign the foregoing instrument purporting to be the last will and testament of him the said John Spence and heard him publish and declare the Same to be his last will and Testament and that at the time of signing the same the Said John J. Spence was of sound and disposing mind and that these deponents subscribed their names thereto as witnesses to the same in the presence of the Said testator at the request of said John J. Spence. Hiram Culbertson - his mark Samuel Culbertson - his mark Subscribed and Sworn to before me the day and year above written. Stephen Chapman Clerk of Probate State of Missouri, County of Stoddard I Stephen Chapman Clerk of the Probate court of Stoddard county having examined the foregoing instrument of writing purporting to be the last will and Testament of and signed by John J. Spence and the Testimony of Hiram Culbertson and Samuel Culbertson the witnesses above named do adjudge and declare the said instrument of writing to be the last will pg. 38 and Testament of John J. Spence deceased. In Testimony whereof I have hereunto set my hand, and affixed the seal of said Probate Court of Stoddard county at office in Said County this 20th day of March AD 1871.
