I Martin Hagy of the County of Stoddard and State of Missouri being of Sound mind and Memory and considering the uncertainty of this frail and transitory Life do therefore make ordain publish and declare this to be my last will and testament. That is to say first after all my Estate real and personal I give, bequeath and dispose of as follows to wit: To my Daughter Malinda Rainey the East half of the North East quarter of Section 15 Township 25 North of Range 10 East Except two Acres in the South East corner of that ... including the Graveyard with all the appertaincess thereto belonging to the said Malinda Rainey at the Some of three hundred and twenty dollars. That the above named two acres I give to the settlement for the use of a Burying ground and School House. Also to my son John Hagy the North half of the South East quarter of section 15, in Township 25 Range 10 East, Containing Eighty Acres with all the appartances thereto belonging at the Sum of four hundred dollars to him the Said John Hagy. Also to my Son Henry Hagy I give four hundred Dollars. Also my Haline Farm and all other lands not heretofore disposed of in the will to ... in possession of my wife Sela Hagy during her natural life then to be equally divided between Mary Hagy, Elizabeth Hagy, Dicey Hagy and Joseph Hagy so as to make them equal with the three eldest Malinda, John and Henry and then the ... heirs also all the ... property my said wife Sela Hagy likewise I make constitute and appoint my said wife Sela Hagy and John Hagy and Henry Hagy the Executrix and Executors of this my last will and Testament. In witness whereof I have hereunto subscribed my name and affixed my seal the second of October in the year of our Lord one thousand Eight hundred and Sixty nine. Martin Hagy The above written instrument was subscribed by the said Martin Hagy in our presence and .... by him to each of us and he at the same time published and declared the above instrument so subscribed pg. 63 to be his last will and Testament and we at the testators request and in his presents have Signed our names as witnesses hereto and written opposite our names respective places of residence. In the Matter of Proving the Last Will and Testament of Martin Hagy, deceased, late of Stoddard County. On this 7th day of February AD 1876 before me, Clerk of the county Court, within and for said county, personally came Jonathan Haislip and Eli Culbertsen who being by me duly sworn in their oath say that they were present and saw Martin Hagy sign the foregoing Instrument purporting to be his last Will and Testament and heard him publish and declare the same to be his Last Will and Testament: That the deponent Jonathan Haislip wrote said instrument at the instance and request of said testator; and then the said Martin Hagy was of Sound and disposing mind, and memory these deponents Jonathan Haislip and Elis Culbertson Subscribed their names thereto as witnesses to the same in the presence and at the request of the said Testator, and in the presence of each other.
