Kenady I, James C. Kenady, of the City of Dexter, County of Stoddard and State of Missouri, being of sound mind, memory and understanding, do make my last will and testament in manner and form following: First, That all of my just debts shall be paid, and all burial expenses also shall be paid. Second, I give to my two brothers William T. and Elias Kenady and my sister Mary E. Fox each of them Five ($5.00) Dollars. Third, I give to my beloved wife Lydia W. Kenady, all of the remainder of my estate of whatsoever nature, real, personal, notes and mortgages. Fourth, If I should leave any children, I hereby appoint my wife Lydia W. guardian of the person and of such as may be minors at the time of my death. Fifth, I hereby appoint my wife Lydia W. the executrix of this my last will and testament, hereby revoking all other wills that have been made by me, my wife to serve as such administratrix without bond. In testimony whereof, I, James C. Kenady, the testator, have to this my last will and testament, set my hand and my seal, this 18 day of Nov 1913. James C. Walker Cooper, Judge of the Probate Court personally appeared Lydia W. Kenady who being duly sworn, says that to the best information and belief of affiant James C. Kenady died testate in Base Hospital 11, in France, on the 17th day of October, 1918 leaving as his heirs at law Lydia W. Kenady, widow; William T. Kenady, brother; Elias Kenady, brother; Hester Olive Lewis, James Whitcomb Lewis and Foster Lee Fox, children of Mary E. Fox, a deceased sister. Lydia W. Walker Cooper, Judge - of the-Probate - Court, held in and for - the County of Stoddard -and State of Missouri, personally appeared - C.M. Hall and Geo. W. Smith - who being duly sworn upon -their -oath, depose- - and say- - that -they -w -ere - present and saw -James C. Kenady - sign the foregoing instrument, of date -Nov. 18, 1913 - 19 - - purporting to be - - the Last Will and Testament of h -im - the said - James C. Kenady - and heard - him -publish and declare the same to be h -is - Last Will and Testament, and that at the time of signing the same, the said - James C. Kenady -was of sound and disposing mind, and that th -ese - deponent - s - and - S.P. Jeffers - the other attesting witness - -subscribed their names thereto as witnesses to the same in the presence of the testat -or - and of each other, and at the request of the said testat -or - who was more than 21 years of age at the date of so declaring and signing said instrument. Walker Cooper, Judge - of the-Probate-Court-of Stoddard -County, Missouri, having examined the foregoing instrument purporting to be - - the Last Will and Testament of - James C. Kenady - deceased, and signed by said - James C. Kenady - deceased, late of-Stoddard - County,- Missouri -and having heard the testimony of -C.M. Hall - and - Geo. W. Smith - subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument -is - the Last Will and Testament of said -James C. Kenady - deceased, and the same is therefore - admitted to probate. Walker Cooper, Judge of Probate LETTERS TESTAMENTARY STATE OF MISSOURI County of-Stoddard To all to Whom these Presents shall come--GREETING: Know Ye, That the last will and testament of -James C. Kenady - deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the -Judge - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that -Lydia W. Kenady - ha -s - been appointed execut -rix -in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize -her - the said - Lydia W. Kenady - as such Execut- rix -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said - James C. Kenady - at the time of h -is - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon - her - by said Last Will and Testament, so far as there shall be property and the law charge -her - ; and in general to do and perform all other acts which are now or may be hereafter required of - her - by law.
