Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ----------------------------------------------------------------------- Record Book of Wills in the County of Stoddard, Missouri Book D Will 105 {This is a form page, the words written in italics are the handwritten words} LAST WILL AND TESTAMENT Know all Men By These Presents: That I, Balis Porter of the County of-Stoddard - State of-Missouri being of sound mind and memory do make and publish this, my Last Will and Testament, in manner and form following: I, Balis Porter of Dudley, R.#1, being now in good health, strength of body and mind, but sensible to the uncertainty of life, and desiring to make disposition of my property and affairs while in health and strength do hereby make, publish and declare the following to be my last will and Testament hereby revoking and canceling all other or former wills by me at any time made. Article first. I direct the payment of all my just debts and funeral expenses. Article Second. I desire that all my property goes to my wife, Alice Gertrude Porter. I also desire that my money goes to my wife namely - Alice Gertrude Porter. Article Third: - I desire that my brothers take no part in nor receive any of my money or property. Brothers names as follows. (1) Marion Porter (2) Chas. Thomson Porter (3) Frank Cleveland Porter (4) Grover Thurman Porter (5) William Henry Porter (6) John Anderson Porter. Article Fourth: - I desire that my sisters take no part in nor receive any of my money nor property. Names of sisters as follows. (1) Mahala Caroline Porter (2) Sarah Ellen Porter (3) Louisa Porter (4) Martha Jane Porter (5) Mary Ann Porter. Article Fifth: - And I further desire that my mother take no part in nor receive any of my money nor property. Mothers name as follows. Polly Jane Porter. Article Sixth: - And a desire also that my children take no part in nor receive any of my money nor property whatever. Childrens names as follows. (1) Minnie Porter (2) Lona Porter. And last I hereby constitute and appoint Alice Gertrude Porter to be the executor without bonds of this, my last will and testament, revoking and annulling all former wills by me made, and ratifying and confirming this and no other to be my last will and testament. Walker Cooper, Judge of Probate Court personally appeared Alice Gertrude Porter, who being duly sworn, says that to the best information and belief of affiant Balis Porter died testate at Dudley, Missouri, on the 10th day of November, 1918, leaving as his heirs at law Alice Gertrude Porter, widow; and Minnie Porter, daughter. BE IT REMEMBERED, That on this - 28th -day of- December -, in the year of our Lord One Thousand Nine Hundred and- Eighteen , before me -M. Walker Cooper, Judge - of the-Probate - Court, held in and for - the County of Stoddard -and State of Missouri, personally appeared - Sol. W. Johnson and James Gillihan - who being duly sworn upon - their -oath, depose- - and say- -that - they -w -ere - present and saw -Balis Porter - sign the foregoing instrument, of date -October 22nd - 19 -18 - purporting to be - - the Last Will and Testament of h - im- the said -Balis Porter - and heard - him -publish and declare the same to be h -his - Last Will and Testament, and that at the time of signing the same, the said -Balis Porter -was of sound and disposing mind, and that th - ese - deponent - s attesting witness - - subscribed their names thereto as witnesses to the same in the presence of the testat -or - and of each other, and at the request of the said testat -or - who was more than 21 years of age at the date of so declaring and signing said instrument. Walker Cooper, Judge - of the-Probate-Court-Stoddard -County, Missouri, having examined the foregoing instrument purporting to be - - the Last Will and Testament of - Balis Porter - deceased, and signed by said - Balis Porter - deceased, late of-Stoddard - County,-Missouri -and having heard the testimony of -Sol W. Johnson - and -James Gillihan -subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument -is - the Last Will and Testament of said -Balis Porter - deceased, and the same is therefore - admitted to Probate IN TESTIMONY WHEREOF, I have hereunto set my hand and affixed the seal of said Court at office this -28th - day of - December - 19- 18 M. Walker Cooper, Judge of Probate /pg. 3/ LETTERS TESTAMENTARY STATE OF MISSOURI County of-Stoddard To all to Whom these Presents shall come--GREETING: Know Ye, That the last will and testament of - Balis Porter - deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the -Judge - of the Probate Court of- Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that -Alice Gertrude Porter - ha -s - been appointed execut -rix - in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize -her - the said -Alice Gertrude Porter - as such Execut-rix -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said -Balis Porter - at the time of h - is - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon - her - by said Last Will and Testament, so far as there shall be property and the law charge - her - ; and in general to do and perform all other acts which are now or may be hereafter required of -her - by law.
