First. I direct that all my just debts, expense of last illness expenses of administration be first paid. Second. That my funeral be directed by my wife, Sarah A. Howell and a suitable monument mark my resting place. Third. I give and bequeath to my beloved wife, Sarah A. Howell all of the property, real personal and mixed, of which I may die seized, to her sole and separate use, during the period of her natural life, with the full power to sell and dispose of the same, or any part thereof, and to convey absolute title. She is hereby empowered to execute deeds to the real estate convey absolute title to said real estate, without any process of count whatever. Fourth. If there be any remainder or residue of my estate at the death of my beloved wife Sarah A. Howell, I direct that a suitable monument mark her last resting place, not to cost less than ($100.00) one hundred dollars, if so much be left, after paying her just debts, expenses of last illness, and funeral expenses. Fifth. After all the requirements of this will has been complied with, and there remain any residue of my estate. I give and bequeath one-half of said residue or remainder of my estate to Mary L. Francis, sister to my wife Sarah A. Howell and the other half to be divided equal between John W. Minton, Marion T. Minton, and Ray Minton, nephews of mine. In case of the death of either of the beneficiaries, then to the surviving beneficiaries, as to the tenor of this will. Sixth. Having entire faith and confidence in my beloved wife, Sarah A. Howell, I hereby appoint her executrix, of this my last will and testament, and that she serve without bond. In Testimony whereof, I have hereunto set my hand this (19) nineteenth day of Nov. 1919. Howell, who being duly sworn says that to the best information and belief of affiant Jordan Howell died testate at Dexter, Missouri on the 6th day of April, 1922, leaving as his heirs at law Sarah A. Howell, widow; Lizzie Lowery, half-sister, and the heirs of Alexia Minton, a deceased sister. Sarah A. Howell Sworn to and subscribed before me, this 7th day of April, 1922 M. Walker Cooper, Judge - of the-Probate - Court, held in and for - the County of Stoddard -and State of Missouri, personally appeared - John P. Stone and J.H. Vaught - who being duly sworn upon - their -oath, depose-- and say- -that -they -w - ere - present and saw - Jordan Howell - sign the foregoing instrument, of date -Nov. 19th - 19 - 19 - purporting to be - - the Last Will and Testament of h -im - the said - Jordan Howell - and heard - him -publish and declare the same to be h -is - Last Will and Testament, and that at the time of signing the same, the said -Jordan Howell -was of sound and disposing mind, and that th -ese - deponent - s attesting witness -es - subscribed their names thereto as witnesses to the same in the presence of the testat - or - and of each other, and at the request of the said testat -or - who was more than 21 years of age at the date of so declaring and signing said instrument. Walker Cooper, Judge - of the-Probate-Court-Stoddard -County, Missouri, having examined the foregoing instrument purporting to be - - the Last Will and Testament of -Jordan Howell - deceased, and signed by said - Jordan Howell - deceased, late of-Stoddard - County,- Missouri -and having heard the testimony of -John P. Stone - and -J.H. Vaught - subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument -is - the Last Will and Testament of said -Jordan Howell - deceased, and the same is therefore - admitted to probate. Walker Cooper, Judge of Probate LETTERS TESTAMENTARY STATE OF MISSOURI County of-Stoddard To all to Whom these Presents shall come--GREETING: Know Ye, That the last will and testament of - Jordan Howell - deceased, late of-Stoddard - County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the -Judge - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that -Sarah A. Howell - ha -s - been appointed execut -rix - in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize - her- the said - Sarah A. Howell - as such Execut-rix -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said -Jordan Howell - at the time of h - is - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon -her - by said Last Will and Testament, so far as there shall be property and the law charge - her - ; and in general to do and perform all other acts which are now or may be hereafter required of - her - by law.
