Collins, all property real, personal and mixed of every kind and description and wherever situated to be her absolute property during her life time, and I give her full power to sell, convey, mortgage or otherwise dispose of any or all of said property if she desires to do so. 2.- After the death of my said wife Mary E. Collins, it is my will that all of my said property, real, personal and mixed, remaining undisposed of by my said wife during her life time, and the proceeds remaining in her hands from the disposition by her of any of said property and also other property, if any, in which she may have reinvested such proceeds shall be divided as follows: One third thereof to the persons who at the death of my said wife, Mary E. Collins, shall be her legal heirs, the same to be divided among them in the proportion in which they would inherit property from her; one third thereof to my brother George W. Collins; one twelfth thereof to Eugene D. Romine, son of my deceased half sister; one twelfth thereof to Myrtle Romine Wall, daughter of my deceased half sister; one sixth thereof to Eliza Forsyth. 3. - It is my wish and desire that my said wife, Mary E. Collins, in so far as practical shall counsel with and secure the advise of my friend James A. Hux, and my brother, George W. Collins, in handling all said property and the affairs connected with said property and my estate, and in executing this will, and I appoint James A. Hux and my brother George W. Collins, Trustees to carry out the terms of this will after the death of my said wife Mary E. Collins, without bond. 4.- And last I hereby constitute and appoint my said wife, Mary E. Collins, to be the executrix of this my last will and testament and request that she be allowed to serve as such without giving bond, and I do hereby revoke and annul all former wills by me made, and I hereby do ratify and confirm this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal this 3rd day of June, 1922. Philip Collins We the undersigned Joel W. Dowdy and Dr. William J. Hux do hereby certify that the above and foregoing was declared to us by the said Philip Collins to be his last will and testament, and that he signed the same/pg.2/as such on the day herein named, and he requested us to sign the same as witnesses thereto, and pursuant to his request we do now in his presence and in the presence of each other sign the same as such witnesses, and do hereby attest that the said Phillip Collins, is of sound and disposing mind and memory. Collins, who being duly sworn, says that to the bet information and belief of affiant Philip Collins died testate at Essex, Missouri on the 10th day of July, 1922, leaving as his heirs at law Mary E. Walker Cooper, Judge - of the-Probate -Court, held in and for - the County of Stoddard -and State of Missouri, personally appeared - Joel W. Dowdy and Dr. William J. Hux - who being duly sworn upon -their -oath, depose- - and say- -that -they -w - ere - present and saw -Philip Collins - sign the foregoing instrument, of date -June 3rd - 19 -22 - purporting to be - - the Last Will and Testament of h -im - the said -Philip Collins - and heard - him -publish and declare the same to be h - is - Last Will and Testament, and that at the time of signing the same, the said - Philip Collins -was of sound and disposing mind, and that th -ese - deponent -s attesting witness -es - subscribed their names thereto as witnesses to the same in the presence of the testat -or - and of each other, and at the request of the said testat -or - who was more than 21 years of age at the date of so declaring and signing said instrument. Walker Cooper, Judge - of the-Probate-Court-Stoddard -County, Missouri, having examined the foregoing instrument purporting to be - - the Last Will and Testament of - Philip Collins - deceased, and signed by said -Philip Collins - deceased, late of-Stoddard -County,-Missouri -and having heard the testimony of -Joel W. Dowdy - and -Dr. William J. Hux -subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument -is - the Last Will and Testament of said - Philip Collins - deceased, and the same is therefore - admitted to probate. Collins - ha -s - been appointed execut -rix -in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize -her - the said --Mary E. Collins - as such Execut- rix -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said - Philip Collins - at the time of h - is - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon - her - by said Last Will and Testament, so far as there shall be property and the law charge - her - ; and in general to do and perform all other acts which are now or may be hereafter required of -her - by law.
