Millen, of Stoddard County, Missouri, being of sound mind and disposing memory, do make publish and declare, this my last will and testament, hereby revoking all former wills by me made. 1. I direct that all my just debts, funeral expenses and the expenses of my last illness be first paid, and if possible, out of my personal estate. 2. I give and bequeath to my daughter Nettie Shepherd, the sum of one dollar. The reason that I do not bequeath her a greater sum is that I know my wife (her beloved mother) will deal justly with her when I am gone regarding any property which her mother may receive under the terms of this will. 3. All the rest, residue and remainder of my estate whatsoever, real personal and mixed, and wherever situate, whether owned by me now or that may be acquired by me hereafter, I give, devise and bequeath to my beloved wife, Sarah Millen. I do hereby appoint my said wife Sarah Millen the executrix of this my last will and testament and request that she be not required to give bond. In witness whereof I have hereunto set my hand this the 19th day of March A.D. 1919. James H. Millen Signed published and declared by the above named James H. Millen to be his last will and testament in the presence of us, who at his request and in his presence, and in the presence of each other have here unto subscribed our names as witnesses thereto. Walker Cooper, Judge of the Probate Court personally appeared Sarah Millen who being duly sworn, says that to the best information and belief of affiant James H. Millen died Testate at Dexter, Missouri on the 31st day of July, 1922, leaving as his heirs at law Sarah Millen, widow; and Nettie Shepherd, daughter. Walker Cooper, Judge - of the-Probate -Court, held in and for - the County of Stoddard -and State of Missouri, personally appeared -R.A. Sisler, and J. F. Blankenship - who being duly sworn upon - -oath, depose- - and say- -that -they -w - ere -present and saw - James H. Millen - sign the foregoing instrument, of date -March 19th - 19 -19 - purporting to be - - the Last Will and Testament of h - im - the said -James H. Walker Cooper, Judge - of the-Probate-Court-Stoddard -County, Missouri, having examined the foregoing instrument purporting to be - - the Last Will and Testament of -James H. Millen - deceased, and signed by said - James H. Millen - deceased, late of-Stoddard - County,- Missouri -and having heard the testimony of -R.A. Sisler - and -J.F. Blankenship -subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument -is - the Last Will and Testament of said -James H. Millen - deceased, and the same is therefore - admitted to probate. Millen - deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the -Judge - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that - Sarah Millen - ha -s - been appointed execut -rix - in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize - her - the said - Sarah Millen - as such Execut- rix -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said - James H. Millen - at the time of h -is - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon - her - by said Last Will and Testament, so far as there shall be property and the law charge - her - ; and in general to do and perform all other acts which are now or may be hereafter required of - her - by law.
