Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ----------------------------------------------------------------------- Record Book of Wills in the County of Stoddard, Missouri Book D Will 15 {This is a form page, the words written in italics are the handwritten words} LAST WILL AND TESTAMENT Know all men by these Presents that, I-W.H.Ryan-of the-County of-Stoddard -and State of-Missouri being of sound mind & Memory do make and publish this, my Last Will and Testament:-in manner and form following: To my wife Suda Ryan, i will and bequeath all of the west half of the South East quarter of Section Sixteen, Township Twenty four, Range Ten, containing 80 acres more or less and 20 acres off of the West End of the North half of the South West quarter of Section Sixteen Township Twenty four Range Ten all in Stoddard County Missouri. Also to my wife Suda Ryan, I will and bequeath all my personal property of every kind including all stock feed machinery of all kinds House Hole Goods and Kitchen Furniture all note money on hand and all money deposited in Banks after paying all Just debts that I owe at the time of my death. Now it is my last will and testament that out of all the property willed to my wife Suda Ryan that she is to pay to my daughter Sarah J. Ryan $1500.00 said $1500.00 to be paid to my Daughter Sarah J. Ryan by my wife Suda Ryan as needed by daughter Sarah J. Ryan to complete her Education pay her board pay her Tuition pay for her books and all other incidental expenses. And if all of the said $1500.00 is not taken up by my Daughter Sarah J. Ryan when she becomes to the age of 21 years. It is my last will and Testament my wife Suda Ryan pay to my Sarah J. Ryan the balance of the $1500.00 that has not been taken up and used by my daughter Sarah J. Ryan. It is my last Will and Testament that my three sons have the East Sixty acres of the North half of the South West quarter of Section Sixteen Township twenty Four Range Ten to be divided equally between John H. Ryan, Louis Ryan and B.J. Ryan./pg.2/ And last, I hereby constitute and appoint Suda Ryan my wife to be executrix with out Bond of this my last Will and testament, revoking and annulling all former wills by me made and satisfying and confirming this and no other to be my last will and Testament. BE IT REMEMBERED, That on this- 28th -day of- February -, in the year of our Lord One Thousand Nine Hundred and-Six-, before me-Geo. H. Crosser, Clerk -of the-Probate -Court, held in and for-the County of Stoddard -and State of Missouri, personally appeared-W.E. Edmond and Geo. W. Ray -who being duly sworn upon-their -oath, depose- -and say- -that-they -w-ere - present and saw-W.H. Ryan sign the foregoing instrument, of date- January 10th-19- 06- purporting to be- the Last Will and Testament of h-im -the said-W.H. Ryan -and heard-him - publish and declare the same to be h-is -Last Will and Testament, and that at the time of signing the same, the said-W. H. Ryan -was of sound and disposing mind, and that th- e- deponent-s -subscribed their names thereto as witnesses to the same in the presence of the testat-or -and of each other, and at the request of the said testat-or -who was more than 21 years of age at the date of so declaring and signing said instrument. Crosser Clerk of Probate CERTIFICATE OF PROBATE STATE OF MISSOURI County of- Stoddard -}In the- Probate -Court I,-Thomas Connelly, Judge -of the-Probate-Court-in & for Stoddard -County, Missouri, having examined the foregoing instrument purporting to be- -the Last Will and Testament of- W.H. Ryan -deceased, and signed by said-W.H. Ryan -deceased, late of- Stoddard -County,- -and having heard the testimony of-W.E. Edmond -and-George W. Ray -subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument- is -the Last Will and Testament of said-W.H. Ryan -deceased, and the same is therefore- admitted to Probate IN TESTIMONY WHEREOF, I have hereunto set my hand and affixed the seal of said Court at office this-28th -day of-February -19-06 Thomas Connelly Probate Judge /pg.3/ LETTERS TESTAMENTARY STATE OF MISSOURI County of-Stoddard To all to Whom these Presents shall come--GREETING: Know Ye, That the last will and testament of- W.H. Ryan-deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the- -of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that-Suda Ryan -ha- s-been appointed execut-rix -in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize-er -the said- Suda Ryan-as such Execut-rox -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said- W.H. Ryan -at the time of h- is -death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon-her -by said Last Will and Testament, so far as there shall be property and the law charge - her -; and in general to do and perform all other acts which are now or may be hereafter required of-her - by law.
