Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ----------------------------------------------------------------------- Record Book of Wills in the County of Stoddard, Missouri Book D Will 158 {This is a form page, the words written in italics are the handwritten words} LAST WILL AND TESTAMENT Will In the name of God, Amen: Eggardine Hansen, the undersigned, being of sound and disposing mind and memory recognizing the uncertainty of life and the certainty of death, and desiring the make disposition of such property as she may die possessed of do so hereby make, declare and publish it to be her will: First: That all just debts including doctor bills and burial expenses, shall be first paid out of her property after her decease. Second: That her beloved daughter, Tula, who has intermarried with Otto Koechig, shall have, own and possess, with full power of disposition in fee all of the real estate and lands of which she may be posses at her death, that is to say, that the undersigned may possess or own at the time of the death of the undersigned testator this bequest applying particularly to the home farm on which this testator now resides. Third: that her beloved grand-son, Griff Koechig, shall have out of her estate the sum of ten dollars. Fourth: That her beloved daughter Mollie, who intermarried with Pete Hansen, shall have a portion of such money as may be left after paying the bequests and debts ... hereafter set out. Fifth: That her beloved daughter, Lena Williams, wife of Dane Williams, shall have the same interest in said estate as is herein given to Mollie Hansen, also the organ. Sixth: That her beloved grand-son, Ernest Andersen, shall have her sewing machine when he shall gave attained the age of twenty one years and other funds hereinafter specified. Seventh: That all moneys that may remain over after paying debts, doctor bills and burial expenses shall be divided, share and share alike, between Mollie Hansen, Lena Williams, Ernest Anderson, Christine Andersen Bierfrannd and no others. Eighth: That she appoints Sam McClard as her executor to perform all necessary acts as such under the terms of the foregoing will. Eggardine Hansen Attestation of Will The foregoing instrument consisting of two pages, was on the 6th day of March, 1920, signed and declared by the said Eggardine Hansen to be his last will and testament in the presence of us who at her request and in her presence and in the presence of each other have subscribed our names as witnesses thereto this the day and year last aforesaid. H. McClard, who being duly sworn, says that to the best information and belief of affiant Eggardine Hansen died testate at Bloomfield, Missouri, on the 13th day of March 1923 leaving as her heirs at law Lena Williams, daughter; Mollie Hansen, daughter; Tulia Koechig, daughter; Christine Bierfrennd, grand-daughter; and Ernest Anderson grand-son. Walker Cooper, Judge - of the-Probate -Court, held in and for - the County of Stoddard -and State of Missouri, personally appeared - Ed Culbertson and Gilbert McClard - who being duly sworn upon - their -oath, depose- - and say- -that - they -w - ere - present and saw -Eggardine Hansen - sign the foregoing instrument, of date -March 6th - 19 -23 - purporting to be - - the Last Will and Testament of h -er - the said - Eggardine Hansen - and heard - her -publish and declare the same to be h -er - Last Will and Testament, and that at the time of signing the same, the said - Eggardine Hansen -was of sound and disposing mind, and that th - ese - deponent - s- attesting witness -es - subscribed their names thereto as witnesses to the same in the presence of the testat -rix - and of each other, and at the request of the said testat - rix- who was more than 21 years of age at the date of so declaring and signing said instrument. Walker Cooper, Judge - of the-Probate-Court-Stoddard -County, Missouri, having examined the foregoing instrument purporting to be - - the Last Will and Testament of - Eggardine Hansen - deceased, and signed by said - Eggardine Hansen - deceased, late of- Stoddard -County,- Missouri -and having heard the testimony of - Ed Culbertson - and - Gilbert McClard - subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said Instrument -is - the Last Will and Testament of said -Eggardine Hansen -deceased, and the same is therefore - admitted to probate. Walker Cooper, Judge of Probate /pg. 3/ LETTERS TESTAMENTARY STATE OF MISSOURI County of-Stoddard To all to Whom these Presents shall come--GREETING: Know Ye, That the last will and testament of - Eggardine Hansen - deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the -Judge - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that -S.H. McClard - ha -s - been appointed execut -or - in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize - him - the said - S.H. McClard - as such Execut-or -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said - Eggardine Hansen - at the time of h - er - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon -him - by said Last Will and Testament, so far as there shall be property and the law charge -him - ; and in general to do and perform all other acts which are now or may be hereafter required of -him - by law. McClard, Executor -of the Last Will and Testament of - Eggardine Hansen - deceased, late of-Stoddard -County, Missouri shall well and faithfully execute the said Last Will and Testament, and shall make true and faithful inventories, returns, and settlements of accounts of the Estate of the said Testator, according to law, and shall, moreover, do and perform all other matters and things touching the execution of the said Last Will and testament, as are or shall be prescribed by law, or enjoined on - him - by the order, judgment or decree of any Court having competent jurisdiction, then this obligation to be void and of no effect; otherwise to remain in full force.
