I Mrs. Soren Jensen Bennesen (formerly Annie C. Man) of the County of Stoddard, in the State of Missouri, aged fifty-nine years, being of sound mind, do make and publish this my Last Will and Testament as follows: I request that my funeral be conducted under the direction of my beloved husband, and in a manner suitable to my means and position in life, and that a suitable monument or stone be placed by him to mark the final resting place of my remains, the cost of which shall be considered as funeral expenses, and I direct that my funeral charges, the expenses of administration on my estate, and all my just debts, be paid out of my personal estate; and if that be insufficient, I expressly authorize my executor hereinafter named, to sell, at public or private sale any part or all of my real estate, as my be sufficient for that purpose. I give and bequeath to my son Theodore Man, he being my only child, the sum of Ten Dollars. I give and bequeath to my beloved husband Soren Jensen Bennesen all the rest residue and remainder of my estate, real and personal of whatsoever kind or nature the same may be. And I fully and completely convey to him all my said property and particularly the land heretofore conveyed to me by the Last Will & Testament of my former husband and described as follows: The South E 1/4 of the North West 1/4 and the North East 1/4 of the South West 1/4 of Section No. Twenty Six (26) in Township No. Twenty-Six (26), North of Range ten (10) East. I have this day conveyed jointly with my husband by a deed in due form to George Houck the above land, to be held by the said George Houck, as trustee, for the benefit of my husband and have thereby and by said deed absolutely parted with any and all rights and interest therein. I appoint my husband, Soren Jensen Bennessen, executor of this my Will, revoking any former Will by me made, and I authorize and empower my said executor in the settlement of my estate and of my debts due me, to compromise such debts and if he things it advantageous to my estate to accept in satisfaction less than the full amount thereof. Green, Judge - of the-Probate -Court, held in and for - the County of Stoddard -and State of Missouri, personally appeared - J.S. Miller - who being duly sworn upon -his-oath, depose-s - and say-s -that -he -w -as- present and saw -Ane Catrine Bennessen - sign the foregoing instrument, of date -December 18th, 1893 purporting to be - - the Last Will and Testament of h -er - the said -Ane Catrine Bennessen -and heard -her -publish and declare the same to be h -er - Last Will and Testament, and that at the time of signing the same, the said -Ane Catrine Bennessen -was of sound and disposing mind, and that th - is - deponent - - and -T.H. Green Probate Judge /pg.4/ LETTERS TESTAMENTARY STATE OF MISSOURI County of-Stoddard To all to Whom these Presents shall come--GREETING: Know Ye, That the last will and testament of -Ane Catrine Bennessen - deceased, late of-Stoddard -County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the - Judge - of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that -Soren Jensen Bennessen - ha -s - been appointed execut -or - in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize -him - the said -Soren Jensen Bennessen - as such Execut-or -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said -Ane Catrine Bennessen - at the time of h - er - death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon -him - by said Last Will and Testament, so far as there shall be property and the law charge -him - ; and in general to do and perform all other acts which are now or may be hereafter required of -him - by law. Sealed with our seals and dated at-Bloomfield, Mo. -in the State aforesaid, this -First -day of -September -A.D. 19-09 The Condition of the Above Bond is, That if the said -Soren Jensen Bennessen, Executor -of the Last Will and Testament of -Ane Catrine Bennessen, deceased - deceased, late of-Stoddard -County, Missouri shall well and faithfully execute the said Last Will and Testament, and shall make true and faithful inventories, returns, and settlements of accounts of the Estate of the said Testator, according to law, and shall, moreover, do and perform all other matters and things touching the execution of the said Last Will and testament, as are or shall be prescribed by law, or enjoined on - him - by the order, judgment or decree of any Court having competent jurisdiction, then this obligation to be void and of no effect; otherwise to remain in full force.
