White -of the-County of-Stoddard -in the County of- -and State of-Missouri being of sound mind and disposing memory do make and declare and publish this, my Last Will and Testament:- 1st I direct that all my just debts, my funeral expenses and the expense of my last illness be first paid, and, if possible out of my personal Estate. 2nd I bequeath and will to my beloved wife, Mattie White, all the remainder of my personal estate after all my expenses and indebtedness are paid as enumerated in the first clause of this will, provided she shall treat me with kindness and affection the remainder of my natural life, with the exception of one bay mare three years old which I give and bequeath to my grand child, Wm. J. White, if my beloved wife should not treat me kindly and with affection as above stated then all the personal property willed to her in this my last will and testament is to revert back to my legal heirs. 3rd I give and bequeath out of my real Estate when sold to my Grand Child Wm. J. White, One Hundred Dollars, and to my Great Grand Child Ethel Brooks One hundred Dollars, and the remainder of the proceeds of the sale of the Real Estate I want equally divided between my beloved children whose names are as follows, W.P. White, T.J. White, P. U. White, J.W. White, Mrs. M.E. Anderson and while my beloved daughter Martha I. McAnally, and R.P. White are deceased I will and bequeath to their heirs their proportional part of the estate. I do hereby appoint Geo. A. Crain Executor of this my Last Will and Testament - leaving to his good judgement as to the best time and opportunity of selling same the sale not to be postponed longer than two years, except the 40 acre Dower interest, that interest to be disposed of at widow's death remarriage or legal contract./pg 2/ In witness whereof I have hereunto set my hand this 25th day of April, A.D. 1904 James H. Reed -who being duly sworn upon-their -oath, depose- -and say- -that-they -w-ere - present and saw-James H. White sign the foregoing instrument, of date- April 25th-19-04 - purporting to be- the Last Will and Testament of h-im -the said- James H. White-and heard-him -publish and declare the same to be h-is -Last Will and Testament, and that at the time of signing the same, the said-James H. White -was of sound and disposing mind, and that th-e - deponent-J. W. Hutchison & J.D. Tucker Clerk Probate /pg.4/ LETTERS TESTAMENTARY STATE OF MISSOURI County of-Stoddard To all to Whom these Presents shall come--GREETING: Know Ye, That the last will and testament of-James H. White -deceased, late of- Stoddard - County, Missouri, hath, in due form of law been exhibited, proved and recorded, in the office of the-Judge -of the Probate Court of-Stoddard -County, Missouri, a copy of which is hereunto annexed; and Inasmuch as it appears that-Geo. A. Crain -ha-s -been appointed execut-or -in and by said Last Will and Testament, to execute the same, and to the end that the property of the said Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said Last Will and Testament may be executed according to the request and instruction of the said Testator, we do hereby authorize-him -the said- Geo. A. Crain -as such Execut-or -, to collect and secure, all and singular the goods and chattels, rights and credits, which were of the said-James H. White -at the time of h-is -death, in whosoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon-him -by said Last Will and Testament, so far as there shall be property and the law charge - -; and in general to do and perform all other acts which are now or may be hereafter required of-him -by law. IN TESTIMONY WHEREOF, I-W.L. Sealed with our seals and dated at-Bloomfield -in the State aforesaid, this- 24th -day of- August -A.D. 19-04 The Condition of the Above Bond is, That if the said-Geo. A. Crain, executor -of the Last Will and Testament of-James H. White -deceased, last of- Stoddard -County, Missouri shall well and faithfully execute the said Last Will and Testament, and shall make true and faithful inventories, returns, and settlements of accounts of the Estate of the said Testator, according to law, and shall, moreover, do and perform all other matters and things touching the execution of the said Last Will and testament, as are or shall be prescribed by law, or enjoined on- him - by the order, judgment or decree of any Court having competent jurisdiction, then this obligation to be void and of no effect; otherwise to remain in full force.
