Strickland decd died without a will as far as he now knows and that he left the following named heirs to wit: Elizabeth Ann, Jane, Jeremiah, Louisa & Sarah all residing in Washington County except Jane who resides in St. Francois County, MO, and that will make a perfect inventory of al faithfully and faithfully administer all the estate after deceased pay the debts as far as the assets will extend and the law direct and account for and pay over all assets which shall come to his possession or knowledge. Perryman, Theophilus Boyer as securities are held and firmly bound unto the State of Missouri in the full and just sum of Four Hundred dollars for the true payment whereof we bind ourselves, our heirs, executors, and administrators jointly and severally firmly by these presents. The condition of the above bond is that if Harvey Blackwell, Administrator of the estate of John M. Strickland, decd, shall faithfully administer said estate, account for, pay and deliver all money and property of said estate, and perform all other things touching said Administration required by law on the order or decree of any Court having jurisdiction then the above bond to be void otherwise to remain in full force this 7th day of August AD 1850. Genevieve Deposition of Witnesses produced, sworn and examined on the 19th day of July AD 1851 between the hours of six of the clock in the four noon and six of the clock in the after noon of said day at this office of this Clerk of the Circuit Court within and for the County of Ste. Genevieve in the State of Missouri before John N. Littlejohn? Clerk of the Circuit Court within and for the County of Ste Genevieve in the 9th Judicial Circuit of the State of Missouri in a certain cause now pending and undetermined in the County land of Washington County in the State aforesaid. Witnesses Harvey Blackwell Administrator of the Estate of John M. Strickland deceased is plaintiff and Titus Strickland is defendant, upon the part of the defendant in accordance with notice previously given which said notice is hereunto attached and forms part of this deposition to wit: Benjamin Baldwin of lawful age being duly produced and sworn to testify the whole truth of his knowledge touching the matter in controversy in said cause and examined as part of the defendant deposeth and saith – that early in the fall of 1848 he the said deposieth was at the Blacksmith shop of the deceased John M. Strickland in the City and County of Ste Genevieve in the State of Missouri then he called at said shop for the purpose of having work done, that at the time aforesaid the said John M. Strickland was at work ironing a waggon which he the said John M. Strickland stated at the time was a waggon which he had brought to the place (City of St. Genevieve), with him, and which he had sold to his Uncle, naming his Uncle Titus Strickland, than he the said Strickland refused to work for this deposieth alleging as a reason therefore then he was employed to iron the aforesaid waggon for his uncle Titus Strickland, and that he the said Titus Strickland needed the use of the aforesaid waggon, but at the request and by the permission of the said Titus Strickland he the said John M. Strickland did the work for this deposieth. Cross examination by the administrators of John M. Strickland – Harvey Blackwell – Do you know whether Titus Strickland paid for this waggon or not? Answer: I do not. (This question was objected to by Mr. Titus Strickland, as irrelevant) And further this deposieth saith not. That in the fall of the year 1848, this deposieth heard John M. Strickland now deceased ask and refuse her husband Joseph Stephens to bring him a load of Day wood to ? him to put the tile on an a waggon for his Uncle Titus Strickland, as said waggon was much needed by his said Uncle, that she further heard the said John M. Strickland state more than once that he had sold the said waggon, (being the same waggon which he the said John M. Strickland had brought to this place City of Ste Genevieve with him to Titus Strickland on account of the agreement of rent due by the said John M. Strickland to the said Titus Strickland for the use of the house in which he the said John M. Strickland resided in at that time, as he the said John M. Strickland was indebted to the said Titus Strickland and had let him have this waggon on account of the same. Cross Examination on part of the Estate of John M. Strickland by the administrator Harvey Blackwell. Do you know whether Titus Strickland ever received this waggon? Answer: He did receive it. Do you know whether John M. Strickland was to finish this waggon or not? Answer: I so understood from J M. Strickland provided his health woud permit. And further this deposieth said not. Littlejohn, Clerk Cir Court Pelagie Dufour of lawful age living being produced second and examined upon the part of the Defendant to testify the whole truth of her knowledge touching the matter in controversy deposeth and saith, that a certain cooking stove and apparatus was left in the house which John M. Strickland occupied in the City of Ste Genevieve that when the said John M. Strickland left said house, the year not now was ? collected said stove was left in said house, or about the same and that she does not believe that within her ? the aforenamed Titus Strickland or anyone of his family did ? at that time or at any time since pretend to claim or own the same, but that he the said Titus Stickland has repeatedly refused to claim the same that when the property and effects of the said John M. Strickland was removed from the house aforesaid by as this deposeth believes his son-in-law Mr. Hale, this aforesaid cooking stove was left behind where it still remains subject so far far as this deposeith knowns to the orders? of those to whom the same may belong and this deposeth has always and does now believe that said stove and apparatus belongs to John M. Strickland or his legal representatives. Do you know any thing about an old pair of saddle bags left at the house afforewaid? Answer: Such a pair was left their. Did your father ever pretend to claim the same? Answer: Not that I know of. And further this deposeth said not. Stricklin deceased that he had fully administrated all the personal estate of said deceased and find the same to be insufficient for the payment of the debts of the deceased that said deceased has no debts due him of which the adm has any knowledge that could be collected.
