Though not all lines are pursued, I wish to record here the ones who left a record they had been there as most seem to be kin though the exact relationship may never be determined. Our Hardy Cain was not the first to arrive; he will be discussed last as his is the line we hope to establish prior to his arrival in Mississippi. WILLIAM CAIN seems to be first. May Wilson McBee, Vol. 2 of THE NATCHEZ COURT RECORDS, 1767-1805, ABSTRACTS OF EARLY RECORDS, p.520 records this: No. 666. Claimant, Reuben Dunham, 17 Mch 1804. Wit. John Graves. Certif. D-252 issued 24 Dec 1806 to William Cane, Assignee. Reuben Dunham claims 400 acres in Wilkinson Co. on Thompson's Creek adj Joseph Dunham. Reuben Dunham for $550 to him paid to William Cane, all right in preemption land, 409 acres. /s/ Reuben X Dunham. Wit. J. Graves. 21 Oct. 1806. AMERICAN STATE PAPERS, Vol. 1 shows the record thus: 24 Dec 1806 #252 WILLIAM CAIN, asse of Reuben Dunham, 400 ac on Thompson's creek. On 29 Feb 1808 a WILLIAM CAIN with his family obtained a passport to travel through the Creek Nation. Because some settlers in this area moved south to LA, the following is given: PAGE 001 ------------------------------------------------------------------------- THE MS CAINS In the Parish of Baton Rouge was a William Cain who had purchased land and was a settler there 1810. AMERICAN STATE PAPERS, Vol. 3. WILLIAM CAIN claim #37, 574.30 ac on Sandy Creek and Amite River, bordered by Joseph Pulliam, Elisha T. Hall, Terrence O'Reilly. Plat T5S, R2E, Greensburg Dist., LA Also on section 27 June 1823 St. Helena #27 WILLIAM CAIN Cert. #52 claims section in E. Baton Rouge as an actual settler, land on Sandy Cr. bounded S by heirs of Joseph Pulliam, N by Francis Milhouse, land on East bank of Sandy Creek. 16 acres. Greensburg District, LA ------------------------------------------------------ From AMERICAN STATE PAPERS, Vol. 2 are two Cain notations: JOHN CAIN #71, 13 July 1807 on waters of Amite, 320 acres. JAMES CAIN #72 13 July 1807 on Waters of Amite, 320 acres. Though James is listed second, I will discuss him first. An Amite Co. census shows: 1816 Amite James Cain M 2(over 21) 7(under 21) F 2(over 21) 1(under 21) Total 12 5 slaves Total 17 This JAMES CAIN family appears to be an older family with possibly two children still in the home over age 21. The following record is most likely for this James and it seems he was the James of the 1807 land record above. Amite county Court Book 1-187: JAMES CAIN vs Mathew Smylie and James Smylie, Aug 1811 court. Smylie broke covenant of 27 Aug 1808. They were to pay Cain 4000 pds seed cotton by Jan. 1811. There was also another JAMES CAIN as evidenced from the record below: 1810 Fr.Co. Not far from this Cain was Hardy Cain who had just arrived in MS and one wonders if he had joined his close kinsman upon his arrival. As early deeds and wills in Fr. Co. burned and the first 9 years after the county was formed (in 1809) marriage records were not recorded, all records available take on added importance. The above records show that James died 1811 or 1812 and left a widow Elizabeth. Some of their children are picked up by the tax record. If Elizabeth was not a wid., her husband's name would have shown. The deeds index was saved from the court house fire and Dempsey P. Cain was sheriff of Franklin Co. A-36 means deed bk. Drawer 78 Case #842 Dempsey P. Cain vs James C. Cain Dempsey P., James C., Hardy, John, E. R., Knox, Susan and Rebecca Cain were heirs of James Cain, Dec'd. Nathan Cain was Exec. Est. James Cain, Dec'd. PAGE 003 ------------------------------------------------------------------------- THE MS CAINS May Flowers Hendrix wrote to Irene Morris (of Kentwood, LA) 19 Aug. 1953 "Checked Cain file in High Court of Appeals yesterday. The pages show very plainly that it was DEMPSEY P. CAIN himself (who) signed the papers as "Orator". I checked again the heirs of JAMES CAIN, decd. They were named as JAMES C. HARDY, JOHN, ELIJAH R., KNOX, Susan and Rebecca". P. Nathan King figured in this suit." (as executor). Note above - the Nathan Cain seems to be an error. See Tempe Fenn Crosby (3246 Conway Dr., Baton Rouge) in her MARSELIS (1978), p.981. From William Hadskey, HISTORY OF FRANKLIN C0., MS comes these notes. JAMES CAIN was appointed chief Justice of the Quorum 8 Jan 1810 for Gov. Holmes. He donated 25 acres for a county seat which was called Franklin. He was a signer of Bond of Tax Collector of the county 22 Jan. 1810. Larry Gates of 402 St. Joseph St., Baton Rouge, LA (or 326 Louise St., Pineville, LA 71360) is a descendant of DEMPSEY P. CAIN and has sent in his lines as (notes from other sources added): JAMES CAIN, d c.1811 Fr. Co., MS; m Elizabeth ____, had the following descendants (order of birth not known): m 1) DEMPSEY P. CAIN, b c.1795, d 25 July 1864 Smith Co., TX; m 1st 22 July 1833 Amanda Nancy Knox; m 2nd 16 Feb 1842 Mary Ann Hereford, b c.1808, dau of Robert Hereford of Mason Co., VA. Amanda Nancy was dau of James and Sarah (Lewis) Knox, niece of Nathan King and 1/2 aunt of Elizabeth Knox King. It is thought that since Port Hudson was so close to and much of the fighting around Baton Rouge on the river happened near them, they fled to TX where he died. Crosby, p.980 quoted Wm. Hadskey as writing. D.P. Cain was one of the charter members of the Ben Franklin Lodge which was organized at Meadville 12 Oct 1824. In the 1824 election for sheriff of Franklin Co., Cain received 331 votes, Jesse Guice 100, then he served as sheriff until 1826. He moved from Fr. Co. around 1830 as evidenced from the following record: Acts passed by MS Legislature concerning estates to authorize the orphans Court of Fr.Co. to make an order authorizing Dempsey P. Cain as gdn. of James Oats, a minor heir of Henry C. Oates to removed person and property of his ward to the state of LA 13th session Jan. 1830, p. 14. See Vol 24, MS Genealogical Exchange. NOTE: Would he have been awarded guardianship had he no wife? 1830 Census E. Baton Rouge Par: p.277 D.P. Cain 1 M(30-40) D.P. Cain also made wagons and coffins in Franklin Co. Dempsey P. Cain was mentioned in St. James Masonic Lodge #47, Baton Rouge 28 July 1844. In HERITAGE OF VALOR on map p.209. D.P. Cain shows on west shore just north of Profit Island and south of a point opposite Port Hudson. On p.172 Dempsey P. and Mary Ann Hereford Cain owned a large tract of land on the west bank of the Mississippi River near the Lobell estate. Their home was 6 miles from Linwood. A newspaper clipping The Way THE PICAYUNE Saw It, May 25, 1896 mentioned "Capt Cain's plantation in West Baton Rouge. nearly opposite Port Hudson.." Cain of $535; one on J. B. Cain for $750. No heirs except brothers and sisters, names not given. SARAH ANN CAIN, a sister, is the wife of William K. Davis. Abram Womack Jr. is the tutor of the minors. Six slaves appraised at $2475.OO St. Helena Par., LA Succession Record. CAIN was a deputy shf 1824-25. WILLIAM CAIN of the 1816 Fr. Co. Tax list could also be a son. was a member of the militia from Fr.Co., War of 1812. JOHN CAIN claimed in 1850 (census) that he was age 80 and born in N.C. This makes him b c.1770. The family claims he married in S.C. Martha Johnson. She was born in S.C., d 1833 in Amite Co., MS. See GENEALOGY OF WILKINSON AND KINDRED FAMILY'S by M.M. Wilkinson, 1949, Mr. Gates, when contacted, was a student at LSU. He said he had other records at his mother's home in Pineville, LA. * * * JOHN CAIN, as noted above, settled on the Amite River in 1807 with JAMES CAIN. This JAMES CAIN seems to have moved on with his entire family after 1816, leaving John who stayed and left a will dated 22 July 1851, proved 20 Oct. 1851, in Amite Co. There seems to be a strong relationship of John to our HARDY CAIN. JOHN CAIN claimed in 1850 (census) that he was age 80 and born in NC. This makes him b c1770. The family claims he married in SC Martha Johnson. She was born in SC, d 1833 in Amite Co, MS. See GENEALOGY OF WILKINSON AND KINDRED FAMILIES by M M Wilkinson, 1949, who claims also that all the children were born in Hancock Co., GA. When he came to MS he settled on the west prong of the Amite River, some 6 miles north of Liberty near where the Gloster road intersects the Liberty-Natchez road close to Zion Hill Baptist Church, though the church was not organized until 1811. Ordered that John Cain be appointed overseer of Franklin Road from the town of Liberty to Amite River and all hands east of the Amite above Crawford Creek as high as Reuben Holloways including the hands on Crawfords Creek work under his direction on sd road. John's son ELIJAH CAIN of Amite Co. died before the father did. Elijah's will is dated 30 June 1845, proved 28 Oct. 1845 and one paragraph in it reads: "13th It is my will that my aged father JOHN CAIN who for many years has made my house his home continue to dwell with my family in the enjoyment of all those priviledges which he hath enjoyed during my life until the close of his remaining days." She married 1811 in Amite Co. Moses Seale who was born 1789 Wilkes Co., GA, d 24 Jan 1852, Greene Co., AL. As he was found on the 1850 Franklin Co., MS census, he had apparently gone to AL very soon before his death to join a kinsman. He left no will, but an inventory of his estate can be found with letter of administration 14 Feb 1859 to Benjamin F. Seale. This is probably Benjamin Franklin Seale, a Baptist minister, b 27 May 1814, his half brother son of Thomas Seale and his fifth wife Lucretia 0'Neal. This record is not available at the S.L.C. Genealogical Library, but can be found in SEALE AND KINDRED FAMILIES by Oswald M. Smith Jr. (1974), p.18. Moses Seale was a Baptist preacher and served several churches in Amite and Franklin Counties. (Casey, AMITE Co. MS, Vol. 3, p.501) In Sep 1818 he was appointed constable in Capt. Meredith's Dist. (Amite Orphs. Court Minutes Vol. 1 p.107) in which office he served a number of years. On 6 Mch 1820 he gave bond to administer the estate of WILLIAM CAIN (brother to Jane, his wife) with security William McDowell and David Hunt. Appraisers of the estate were John Meredith, Thomas Collinsworth and David Day. (Amite Will & Adm. B-74, Probate Rec 3-94 and Orphs Ct. Min p 161.) His name is mentioned numerous times in Albert E. Casey, AMITE COUNTY, MISSISSIPPI, Vol. II in the abstracts of the minutes of the churches of Amite Co. on 1 Oct 1825 he and his wife Jane were received into Zion Hill Baptist Church by experience. It was on his land that the church had been built as shown by the following deed. 20 July 1829 Moses Seale and his wife Jane Seale of Amite Co. sold to John Meredith, trustee for $30 8 and 73/100 ac to secure the Zion Hill Meeting house, school house and all the public buildings pertaining thereto, the E/2 of NW/4 Sec 29 R4 T4E. /s/ Moses Seale, Jane X Seale. Jane was privately examined.. (Amite Deed 2-359). When Meredith reported back to the church on 4 Apr 1829 after he had contracted with Brother Moses Seale for the transaction, it was reported it was "satisfactory to the minds of the Church". It is interesting that the remainder of this land was sold by Moses on 21 Feb 1835 to Elijah Cain for $100 78 ac, except the 10 ac belonging to Zion Hill Meeting House, the E/2 of NW/4 Sec 29 T4 R4E. Jane Seale relinquished her dower in this land. The minutes of the MS Baptist Association showed him a delegate many times between 1832 and 1847, usually as a delegate from Zion Hill. It is said that he helped to organize Spring Hill Baptist Church at Knoxville, MS 1842. On 28 Oct 1838 Bro. Moses Seal was given the approbation of the Church to exercise his gift in public in any way he may feel to be his duty among the churches as well as at home. 3 July 1841 a presbytery was chosen to ordain him to the ministry. Minutes of Zion Hill Church. 1850 he was a Baptist minister in Franklin Co., MS. At a meeting of the MS Association in 1852, he was reported as having died 24 Jan. 1852. Apparently, his last days were not peaceful ones as he and Jane separated as reported by Zion Hill Church in their minutes. On 7 Jan 1843 Bro Moses Seale prepared a charge against his wife Jane Seale for having declared an unfellowship for him as a Christian husband or friend. Sat. 11 Feb. Charge against Sr. Jane Seale was sustained & Sr. Jane Seale excommunicated from the fellowship of this Church. Sr. Elizabeth Bonds preferred a charge against Bro Moses Seale for having publicly declared an unfellowship for his wife, previously to having charged her with the same. Brethren C. Felder, S. Coker, Z. Reeves, H. F. Roberts, W. Clark as a presbytery to investigate the charge against Moses Seale. 13 May owing to an entire failure of the attendance of the Presbytery, Bro Seale requests for the special happiness & prosperity of the Church to be excom. from the fellowship of the church. granted. Also the church having thorough knowledge of Sr. Martha Bond having attached herself to the Methodist Society, she is hereby excom. from the fellowship of this church. Moses Seale offered a restoration of the church was opposed by Sr. Elizabeth Bond. Victoria Co. probate minute Bk. 3A-63 shows A.D. Beaty adm. had in his possession a joint stock of cattle that is a portion of the Wm. Bailey & wife as well as that of Elisha Seal & his widow, now decd. The heirs of Wm. Bailey are entitled to a certain interest in the Seal stock as heir of their mother, and Emma Seal is entitled to a certain share in the Bailey stock as heir of her mother and the two stocks being about equal in number and by consent merged. It is ordered that the heirs of Wm. Bailey, to wit. Oliver Bailey is entitled to 5/16 and Cyrus Bailey also entitled to 5/16 and Emma Seale to 6/16 interest in the blended stock and of the money derived from the sale of the homestead. On May 1871 A.D. Beaty was dead; also Aaron Van Norman was dead, Charlotte Van Norman admx. On p.363 is found the release: I Emma Charlton of the co. of Matagorda for money paid to me by J.M. He m 25 July 1844 (Amite 4-3) to Elizabeth Ann McMillan, b 14 Oct 1826 MS, d 1 Sep 1919, MS, both bur in the Elijah Seale Cemetery near the Mt. Olive Methodist Church on what is known now as the Dougle E. Seale place, about 10 miles south of Meadville, Sec. 41 T5 R3. Elizabeth is dau of John McMillan and Charity Jones. Her brothers helped Elijah build the home where all his 14 children were born and raised. The house was built of hand hewed logs, cypress shingles, and put together with wooden pegs. There was a breeze way the length of the house running the length from porch to the rear with rooms on either side. Adjacent were the smokehouse, spring house and blacksmith shop. There were no door knobs but a well worn latch string. The Elijah Seale Cemetery was directly behind the house. After the death of Elijah and Elizabeth Ann Seale, the house became the home of Dougle Elijah Seale, their son, and there he raised his family of eleven. Elijah served in 2nd Reg. MS Inf. (Quinn's State Troops) Army of the Confederate States of America. In her application for a Pension, Elizabeth A. Seale stated in 1916 that she was 89 years old, living with her dau Mrs. C.M.
