Ms Written: June 2, 1840 Recorded: July 26, 1841 The Last Will and Testament of Gabriel Caston ______________________________ ------------------------------ The State of Mississippi § In the name of God amen Amite County § I Gabriel Caston a citizen of the State and County aforesaid being of sound and disposing mind do hereby ordain and establish this my Last Will and Testament. First - I request that my body be buried in a plain and decent style. Second - I request that all my just debts be faithffully (sic.) paid. Third - I give and bequeath unto my beloved wife Mary E A Caston during her natural life or widowhood the following described lands viz, one quarter of Section with the dwelling house gin out-houses etc. The South West quarter of section thirty five in Township one of Range two East. also the quarter Section that I purchased from James Gormley(?) the South East quarter of Section thirty seven, in Township one of Range one East, and also one quarter section that I purchased from Robert Graves. The north quarter of Section thirty seven, in Township one of Range one East, I also give and bequ- -eath unto my beloved wife during her natural life or widowhood the following slaves viz- one negro man named Jesse, and his wife Terios(?) and their children, Charlot Hannibal Sealy and Pompey, and all their natural increase, also one negro man Lewis, one negro man Silas, one negro boy little Jesse and one negro boy Deucus(?) and such horses, cows and stock as my Executors shall deem necessary to carry on her farm, and such household furniture as she may wish to retain and also her ____ which she may dispose of to whom she thinks proper. [p.215] Fourth - I give and bequeath unto James J.R. Gabriel Mary Edward and Eliza Caston the children of my eldest son Laban G. Caston and wife Assalee and all their bodily increase to share and share alike the following described lands viz, the north west quarter of Section forty nine in Township one of Range one West, the quarter of Section in Wilkinson County that Laban G. Caston now lives on also one quar- ter of Section that I purchased from Joseph Caston the north west quarter of section forty nine in Township one of Range one. I also give and bequeath unto the aforementioned chi- dren of the said Laban G Caston one fifth part of my slaves after deducting these from all the negroes and money which their father, the said Laban, has received by way of advan -cement, three negroes, one woman Mary, one girl Sophy one boy Tom and the amount of money for which I hold his receipt, and I further devise that the said Laban G Caston and wife Assalee shall keep the property real and personal in their possession during their natural life, for the maintenance of their children as mentioned before, and in case any of the children of the said Laban should die shall decend to the aforementioned children. Fifth - I give and bequeath unto my eldest daughter Eliza M Boatner, one other fifth part of my slaves after deducting therefrom five slaves, one woman Malinda her son George which I aadvanced to the said Eliza M. and these other slaves, one boy Jesse two girls Martha and Fancy which I have given her by Deed of Gift. Sixth - I give and bequeath unto my son Seth P Caston independent of his wife Martha the following demensed land viz the north west quarter of section thirty five of Township one in Range two which I purch ased from Samuel Nesmith, conveyed by Lawrence [line missing] [p.216] one quarter of Section which I purchased from Benjamin Hice(?) the north west quarter of Section thirty five, Township one in Range two. I also give and bequeath unto him, one other fifth part of my slaves of which he has received by way of advancement the following four negroes viz, one negro man Bill one woman Caroline and two children Andy and Jack. Seventh - I give and bequeath unto Sarah C Gayle one other fifth part of my slaves of which she has received by way of advancement the following three Negroes, one woman Amy her son Henry and one girl Haly which I have given her by Deed of Gift and also three hundred and twenty five dollars. Eighth - I give and bequeath unto my daughter Aman- da E. Caston the following described land viz. The South East quarter of Section thirty seven in township one of Range one East, and also the South East quarter of Section forty nine in Township one of Range one East. I also give and bequeath unto her one other fifth part of my slaves. And when she marrys I devise that she shall receive a portion of slaves, one horse bed and furniture equal to my other children at the time of their marriage by way of advancements. Ninth - I further devise in case my daughter Sarah C Gayle should die without bodily heirs the share of proerty allotted to her shall revert back to my heirs and legal representatives in this will. Tenth - At the death of my wife Mary E A Caston I give and bequeath unto the aformentioned children of Laban G Caston, one quarter section of land that I purchased from Robert Graves, the north quarter of section thirty seven in Township two of Range one east and also the west half of the quarter section that I purchased from James Gormley(?). Eleventh - At the death of my wife Mary E A Caston I give and bequeath unto Seth P Caston one quarter section of land containing the buildings where I now live the south west quarter of Section thirty five in Township two of Range two East, and also the East half of quarter section that [p.217] I purchased from James Gormley(?). Twelvth, And as to all the slaves that may be in possession of my wife Mary E.A. Caston at her death I devise that they shall be divided among the same legatees as mentioned above in equal portions. And I further devise that the household furniture and stock of all kinds farming utensils etc. that may be in possession of my wife Mary at her death shall be divided among my legatees in equal portions. Thirteen - I further devise that my son Seth P Caston heirs at the death of my wife Mary shall be bound pay unto my two daughters Eliza M Boatner and Sarah C Gayle one thousand dollars each first payment to be made twelve months after the death of my wife, and the remaining part in equal instalments of one Hundred dollars to each of them until the whole debt is discharged Fourteenth - I do hereby make ordain constitute and appoint Seth P Caston Jarrot Caston and Erasmus Caston Executors of this my Last Will and Testament. I empower my Executors to keep all my property together for one or two years as they may think expedient to discharge all my just debts. I further devise that my executors shall receive as a compensation for their services the sum of five hundred dollars each, done this June 2nd A.D. 1840. Caston {seal} [p.218] State of Mississippi § Probate Court Amite County § July Term 1841 Personally appeared in open court Phillip Huff Wm B Dunn & Wm G Boyed the subscribing witnesses to the above and preceding instrument of writing who being duly sworn saith that they saw Gabriel Caston sign and seal the same and that they heard him declare it to be his last will and testament that they these affiants signed the same as witnesses in the presence of the said Testator and at his request, and in the presence of each other.
