Franklin (NOT associated with Tracking Your Roots) lisafranklin2004@earthlink.net January 15, 2017, 10:59 pm Source: Amite Co, Ms Will Book 1818-1922 Pages 102-104 Written: March 24, 1830 Recorded: January 31, 1831 Page 102 The last will and Testament of James Chandler In the name of God Amen I James Chandler of Amite County in the state of Mississippi being mindful of my mortality and now of a sound and disposing mind, do make and declare this my last will and Testament hereby revoking and annulling all wills heretofore made by me – first it is my will and wish that all my just debts be paid out of my Estate The rest of my worldly Estate I dispose of in the following manner, First I give, devise, and bequeath to my beloved daughter Catharine Norwood wife of Elias Norwood one negro woman named Berry and her four children namely Horace Permelia, John and Luanda with her and their natural increase I also give to my said daughter Catharine Norwood one thousand dollars It is my will and wish & I hereby direct, that all my property both real and personal except my Bank Stock be sold at public auction and my Bank Stock viz fifty shares in the Bank of Louisiana and twenty in shares in the Bank of the State of Mississippi I wish sold to the best advantage by my Executors herein after named and the money and proceeds arriving and accruing from the sale of all said property I dispose of as follows to wit I give and bequeath to the children of my deceased daughter Martha Burris late wife of William Burris of Darlington District South Carolina the number and names of them I do not know Page 103 four thousand dollars to be equally divided between them if however any of the children of my said daughter shall have died leaving heirs of his or her body then such deceased Parents part of the said four thousand dollars to go to the said heirs of his or her body. I also give and bequeath to my step daugh- ter Jane Wells wife of George Wells of Hinds County Mississ- ippi, one thousand dollars. Also I give and bequeath to Saml B. Simmons my step son one thousand dollars. Also I give and bequeath to my two granddaughters the daughters of my deceased son Jesse Chandler, their names I do not know, four thousand dollars to be equally divided between, when they shall arrive at the age of twenty one years or marry, but if either of them dies before she arrives at the age of twenty one years or is married then her part of the said four thousand dollars shall go to the survivor and if both of them should die before they arrive at the age of twenty one years or marry, then the said four thousand dollars to go to and be equally divided amongst the children of my said daughter Catharine Norwood and the children of my son James Chandler. All the rest and residue of my estate of what kind soever and not herein before given and disposed of I give and bequeath as follows viz I give one half thereof to my said daughter Catharine Norwood, I give one fourth part thereof to my son James Chandler, the remaining one fourth part thereof I give and bequeath to the children of my said son James which are acknowledged by him to be such, to be equally divided amongst them. Also I give and bequeath to my son James Chandler my wearing apparel. And I do hereby appoint Elias Norwood my son in law and Samuel B Simmons my step son Executors of this my last will and testament to execute the same. In witness whereof I have hereunto set my hand and Seal this twenty fourth day of March in the year one thousand eight hundred and thirty. James Chandler {seal} Signed sealed published and declared by the said Testator as & for his last will and testament in presence of us who at his request and in his presence and also in the presence of each other have subscribed our names as witnesses thereunto John C Wilon, Enos Burris, Stephen H Strong Page 104 State of Mississippi} Amite County } Personally appeared in open Court John C Wilson one of the subscribing witnesses to the within instrument of writing who being first duly sworn deposeth and saith that he saw the within named James Chandler sign seal publish and declare the within instrument of writing to be his last will and testament, that he at the request of the said James Chandler signed his name aza witness thereto in the immediate presence of the testator that he saw Enos Burris & Stephen H Strong sign the Same as witnesses in the presence of the testator & in the presence of each other Sworn to and subscribed in John C. Wilson open Court January 31st 1831 W Baker Regr. O. C. A. C. Additional Comments: James Chandler is probably the same person as James Chandler found in 1790 St Thomas, Cheraws District, SC. He is found in Darlington Co, SC in 1800 and in Amite Co, MS in 1820 & 1830. Catharine Chandler married Elias Norwood 17 Dec 1815 in Amite Co, MS. Elias Norwood build Richmond Plantation, Norwood, East Feliciana Parish, LA. He is found in East Feliciana Parish, LA in 1820 & 1830 and his widow, Catharine, is there in 1850-1870. A William Burris is found on census records in Darlington Co, SC 1810-1830. The will of William Burris was written 16 Oct 1840 & probated 18 Jan 1841 in Darlington Co, SC (Will Book Vol 8-10, 18290-1859 pgs 11 & 12). If this is the William Burris who was married to the deceased Martha Chandler, he names his wife Jane and children Ira E Burris, William Mitton Burris, Emily Fraser, Samuel Burris Jane Elizabeth Burris, John Burris, Martha Salmonds, Robert Lenn Burris, George Burris & Sarah Jane Burris with the last 3 being clearly named as his youngest children. If common practice was followed, the children were named in the order of their births, however, I cannot at this time determine which were children of Jane Chandler. Samuel B Simmons married Harriet Burris 12 Oct 1810 in Amite Co, MS. Samuel B Simmons is found in Amite Co in 1820 & 1830. Samuel B Simmons married Eliza W Dunn 29 Aug 1839. He is found in Hinds Co, MS in 1840 & 1850. A will by Samuel B Simmons was written 4 Sep 1862 with probate 24 May 1864-4 Jun 1864 in Holmes Co, MS. I have not taken the time to thoroughly research this information and cannot at this time guarantee that all these records on Samuel B Simmons refer to the same individual. Samuel's sister, Jane B Simmons, married George Wells 10 Dec 1810 in Amite Co, MS. George Wells is found on the 1820 & 1830 Amite Co, MS census. Jesse Chandler married Mary W Eppes 10 Feb 1825 in Amite Co, MS. Jesse is deceased by the date of this will and his two daughters, at this date, remain mysterious & unnamed. It is very tempting to assume that Jesse must have moved away from Amite Co, MS if the names of his daughters were unknown to their grandfather, James. I have no idea where Jesse lived or died. At this point, I have no data on the younger James (Jr). Witnesses Stephen H Strong & John Wilson are found on the 1830 Amite Co, MS census.
