This document was found among the Copiah County loose probate records. It is badly damaged. It is dated 1833, so it can't be referring to the Moses Foster who wrote his will in Copiah county in 1857 and died in 1860. Because it identifies this Moses Foster as 'sen' I feel it must be referring to the Moses Foster who married Otemasa, the Choctaw woman. This is also good evidence that he was the father of the Moses Foster from Maryland who died in Copiah county in 1860. This raises the likelihood that Moses Foster senior was married before he married Otemasa, probably in Maryland. If so, he must have had white as well as mixed-blood children. Douglass {badly torn along the left side and bottom] Know all men by these presents that we Moses Foster and Thomas Holliday and William Graves are held and firmly bound in the [ink blot] Thomas Keller Judge of the Court of Probates in and for the Copiah County in the penal sum of fifteen hundred dollars and for the payment of which will and truly to be made we bind ourselves our heirs executors and administrators severally and firmly by these pres[ . . .] Sealed with our seals and dated the 26th of June 1833 the condition of the above obligation is such that if the said Moses Foster administration of all and singular the [gap -- appears that a page is missing] $15.00 goods, chattels & credits of the estate of Moses Foster sen. and make a true and Perfect inventory of all & singular the good chattels and credits of the said decd [missing] have or shall come into possession on [. . .] of him the said Moses Foster or in the hands [ . . .] of any other person or persons for him and [ . . .] so make do Exhibit unto the court of [ . . .] Copiah County when it shall be thereunto required by the said court of such goods and chattels and credits do well & truly administer according to law & further do make a just and true account of his actings and doings there on when there be required by the said court and all the rest of said goods chattels & credits which shall come to his hands or be found remaining upon the account of the said adm the same being first examined & all --?-- and allowed shall deliver & pay unto such persons respectively as are entitled to the same by law & if it shall hereafter that any last will or Testament [ink blot} by the said deceased appear and the same to be produced in court and the Executors on Executing obtain Letters testamentary and the said Moses Foster of in such case being and required of and deliver up his letters of administration then this obligation to be void else to remain in full force The State of Mississippi you do solemnly swear that Moses Foster deceased died without any will as far as we know or believe and he will & truly administer all and singular the goods chattels and & cre[ . . .] the said deceased & pay his debts as far as his [ . . .] chattels & credits will extend also a Just and [ . . .] thereto required so help me God M Fo[. . .] Sworn to signed and subscribed in open court this 24th June 1833 John G.
