Personally appeared in Open Court at the above term, William Foster of Sumpter County in the State of Georgia, and William T. Foster of the County of Copiah and Shem T. Foster of Sumpter County Georgia, who being duly sworn on their oaths, respectively say that James M. Foster who appears before this Court as the heir and executor of the noncupative last will and Testament of James Foster, late of this County, deceased, is the identical James Foster named as the heir of William Foster of Sumpter County Georgia near Pontown Post Office, and heir of the said deceased. Sworn and subscribed in Open Court this 23rd January 1850 ED Brown clk William Foster William T. Foster Shem T. Foster Copiah Co., Mississippi Est of James Foster Decd Pet. of F. T. Foster for div of real estate Hon. M. H. Peyton Judge of the Probate Court of Copiah County State of Mississippi The petition of Felix T. Foster respectfully --?-- that James Foster died in the year 1837 seized and possessed of the following tract of land situate in the county of Copiah aforesaid to wit; the North half of Lot 2 and the north half of Lot 3 in section 28 township eleven range five east containing 89 88/100 acres and that the said James Foster left surviving him the following children -- Sarah Foster and Nancy A. Foster residents of Copiah county state of Mississippi; Shem T. Foster and your petitioner Tabitha Foster and Rebecca Harlan since deceased and who left the following children -- Lewis Harlan, Martha B. Harlan, Nancy O. Harlan and the last two being minors A. W. Harlan and S. W. Harlan non-residents of the state of Mississippi. You petitioner shows that he is (illegible) of Shem T. Foster's interest in said land by a deed of conveyance from him duly executed and recorded and that he is the guardian of Martha B. and Nancy O. Harlan . . . F. T. I haven't been able to trace his family yet, but I suspect he's related to the Foster (Forrester) family that came from Georgia and settled in Claiborne Co., Mississippi in the early decades of the 1800s.
