Love (or Lowe) Sheriff of Copiah County State of Mississippi and special Commissioners of the Chancery Court of Copiah County witnesses that whereas at a time of said Court held at the Courthouse of said County on the 2nd Monday of April 1868, Littleberry Moody in a certain suit in said Chancery Court then and there pending received and obtained at said time of said Court on the 4th day of May 1868 a decree of foreclosure against John D. Taylor et al Defendants in said suit for the sum of seven thousand one hundred and twenty dollars and twenty three cents with interest at eight per cent per annum and costs of suit and it was ordered and decreed by said Court that the said defendants pay said complainant within 30 days from the date of said decree the sum of money with interest and costs, and in default thereof, it was ordered and decreed that the equity of redemption of the said defendant in the mortgaged premises described in bill o6,&7 in Block 10 (?) and Lots Nos. 6 &7 in Block No. 7, also 10 acres adjoining said town, sold to Paul H. Harper, or so much thereof as may be necessary to satisfy the said sum of money interest and costs be sold by said Sheriff according to law for cash to the highes bidder and whereas said defendants failed to pay and satisfy said decree or any part thereof and whereas before any sale of the mortgaged premises was made pursuant to said decree the said Littleberry Moody departed this life testate, of whose last will and testament Josephine M. Moody was duly appointed and qualified Executrix, and whereas the said decree was by the said Chancery Court at the October term 1868 thereof on the 23rd day of October 1868 revived in the name of said Josephine M. Moody, Executrix of the last will and testament of Littleberry Moody deceased and against the said defendants in due form of Law and said Chancery Court then and there ordered and decreed that the said original decree do stand be prosecuted and carried into effect in the name of said Josephine M. Moody Executrix as aforesaid against the defendants therein, and that the said Sheriff proceed to execute the same in the manner directed in said final decree and whereas said decrees were only issued and came to the hands of the Sheriff and whereas the said Sheriff after having given the notice required by law, and the directions of said decrees ord.(?) on the 1st Monday 7th day of December 1868 between the hours prescribed by law expose to public sale to the highest bidder for cash at the door of the Court house of said County in the manner & upon the terms prescribed by law said decrees, the said lands directed in and by said decrees, to be sold as aforesaid , when and where Gabriel Moore of said County appeared and bid for the following parts of said lands to wit; Lots 1,2,3,13,14,15,16 in Block 11 and Lots 5,6,7,8,9,10,11,&12 in Block 6 the sum of Two dollars and fifty cents which being the highest and best bid therefor, the same with the appurtenances were struck off to him, now this deed witnesses that in consideration of the premises and that the said Gabriel Moore has paid to the said Sheriff the said sum of Two dollars and fifty cents the said Aaron B. Love (or Lowe), Sheriff as aforesaid, has this day granted, bargained and sold and by these presents does grant, bargain, sell and convey unto the said Gabriel Moore his heirs assigns in fee simple forever all of said lands struck off to him as aforesaid with the priviliges and appurtenances therewith belonging or in any wise appertaining and all the right title interest claim and demand whatever at law or in equity of the said defendants and their heirs of in and to the same.
