DEED - Willis Hester to Thos. Brooks Transcribed & submitted by Lori Thornton Itawamba County, Mississippi Deed Record 21, p. 279 Willis Hester To Deed Thos. Brooks This Indenture made and entered into this December the fifth day A.D. 1860 between W. Hester & Telitha Cumi his wife of the first part and Thomas Brooks of the second part all of the County of Itawamba & State of Mississippi Witnesseth that for & in consideration of the sum of Seven Hundred Dollars cash in hand paid by the party of the second part to the party of the first part the Receipt whereof is hereby acknowledged the party of of [sic] the first part have this day bargained sold and conveyed & by these presents doth grant bargain sell convey and deliver unto the party of the second part the following described tract or parcel of Land to wit: The South half of the North West quarter of Section Nineteen Township Ten Range Eight East of the Basis Meridian of the Chickasaw Cession in said County & State to have & to hold the above described Land with all & singular the hereditaments & appurtenances thereunto belonging to the only proper use of him the said Thomas Brooks his heirs and assigns forever & the party of the first part do hereby warrant & will forever defend the Title to the above described Land against the claims all person whomsoever lawfully claiming the same. In Testimony whereof the party of the first have hereunto set their hand and affixed their Seal the day & year first above written. Willis Hester [seal] her Telitha Cumi X Hester [seal] mark The State of Mississippi} Before me David Johnson an acting Itawamba County} Justice of the Peace in & for said County personally came Willis Hester whose signature appears to the foregoing Deed who acknowledged that he signed sealed & delivered said Deed on the Day & date thereof as his own act for the purposes wherein contained. Also personally came Telitha Cumi Hester wife of said Willis Hester who being by me examined seperate [sic] & apart from her said husband acknowledged that she signed sealed and delivered said Deed on the day and date thereof as her own act freely without fear threat or compulsion of her said husband for the purposes therein mentioned. Thomas Clerk of the Itawamba County} Chancery Court of said County hereby certify that the foregoing Deed duly stamped and acknowledged was filed for Record in my office on the 28 day of April 1871 and that the same has been duly Recorded in Deed Book No. 21 on page 279.
