Deed between Daniel Moore & T. G. Melton & T. Scott Book N page 434, 435 D. Moore & wife to & Mortgage T. G. Melton & T. Scott} Received of Record 17th February & Recorded March 2nd State of Mississippi, Madison County} This indenture made and entered into this 31st day of January 1855 by and between Daniel Moore and with Mary his wife of the first part and Thomas G Melton and Thomas M Scott on the second part all of the County and State aforesaid. Witnesseth the said Daniel Moore is justly indebted to the members of this Board of Trustees of School and School lands of Township Nine Range 4 East [in said] County in the sum of eight hundred and two dollars and fifty cents evidenced by the Promissory Note of said Moore and the said Milton & Scott, the said Milton and Scott being in truth and in fact only the securities of said Moore. Now for the purpose of security and punctual payment of said note and also to secure and save harmony said party of the second part who are only sureties for said Moore and for the farther consideration of five dollars in hand paid to said Moore by the said party of the second part the receipt whereof is hereby acknowledged the said party of the first part for the consideration aforesaid bargains sells grants and conveys and does by this indenture bargain sell and convey unto the said party of the second part his heirs and assign forever the following described land lying and being in said county and known as the west half of section thirty two all in Township one Range 3 East. To have and to hold said land to the said parties of the second part their heirs and assigns forever and the said first party hereby warrants the title of said land to said party of the second part their heirs and assigns forever. But should said party of the first part pay off and discharge said indebtedness in deed and indemnify and [free] himself from all damages [by] said party of the second part and sureties as aforesaid then all the estate and title hereby conveyed ___ and determine and ____ in said Moore but otherwise this deed to remain unfiled ___and virtue. In testimony whereof the said party of the first part has hereto set their names and seals this day and year above written. Also I have examined Mary Moore his wife separate and apart from her husband who acknowledged that she signed the above deed without any fear threat or compulsion of her husband Daniel Moore.
