Mary Smith & Thorough Smith Deed to Daniel Moore} This deed of conveyance, executed this 15th day of November AD 1870, by Thorough Smith and Mary Smith, his wife, to Daniel Moore all of the County of Madison and State of Mississippi, Witnesseth, that foe and in consideration of the sum Five Hundred dollars cash in hand to the said Mary Smith now paid, and the promissory note of said Daniel Moore, to the said Mary Smith of even date with this deed, payable November 1st AD 1871 for the sum of two hundred dollars to be made, a lien is now served on the land hereinafter conveyed, to ensure to the benefit of any lawful holder of said note, the said Mary Smith has bargained and sold, aliened and conveyed, and by these presents do now bargain and sell, alien and convey unto the said Daniel Moore, and his heirs forever the following lands situated in the County and State aforesaid viz. Thirty (30) acres off of the SW corner of the NE 1/4 of Section twenty six (26) and the N 1/2 of the E 1/2 of the SW 1/4 of section twenty six (26) all in Township ten (10) Range two (2) East containing, by estimation seventy (70) acres, more or less, To have and to hold said land, with all appurtenances to the same belonging unto the said Daniel Moore, his heirs and assigns forever. And the said Mary Smith covenants that she will warrant and forever defend by herself, her heirs, executors, or administrators the title to said land against the lawful claim of any and all persons whomsoever. In testimony of all which the said Grantors hereto set their hands and seals, and the Revenue Stamp required by law on the day and year just above written. T. P. Smith M. A. Smith State of Mississippi, Madison County} Personally appeared before me E. S. Jeffrey, clerk of the Chancery Court of said County the within named T. P. Smith and M. A. Smith his wife, who severally acknowledged that they signed, sealed, and delivered the foregoing and annexed deed as their own act and deed. And the said M. A. Smith upon a private examination, separate and apart from her said husband, acknowledged that she signed, sealed and delivered the same as her own voluntary act and deed without any fear thereat or compulsion of her husband.
