Deed between Wm. S. Bailey & Daniel Moore(property of Ebenezer Divine) Book K, page 215 Wm. S Bailey, Sheriff Deed Daniel Moore} Received for Record 1st & Recorded 17th June 1846. This indenture made and entered on this 16th day of March Anno Domini one thousand eight hundred and forty six between William S Bailey Sheriff of Madison County, Mississippi of the first part and Daniel Moore of the second part. Witnesseth that whereas judgment was rendered by the Circuit Court of the County of Madison aforesaid, and against Ebenezer F Divine in the following case, viz. At the November Term 1842 of said Court as aforesaid, to wit: Tallius E. Tuffs [?] vs. Ebenezer F Divine for the sum of four hundred dollars with interest at the rate of 8 per cent per annum from date until paid and cost of suit and al____ writs of Fun facias paid from the office of the Clerk of the Circuit Court aforesaid, directed to the Sheriff of Madison County aforesaid Commanding him that of the goods and chattels land and tenements of the aforesaid Ebenezer F Divine be caused to be made the sum of money mentioned and submit to render to the said plaintiff at the April Term AD 1846 of said Court, and the said Sheriff in conformity to the command of said writ did have on the fifth day of February AD 1846 on the following described Lot in the town of Sharon the property of said defendant Ebenezer F Divine lying and being in the County of Madison aforesaid, known as follows, To Wit: a Lot of land in the east half of Section One Township Nine Range 3 East, in the Town of Sharon bounded as follows: East by the lands of the Methodist Episcopal Church - Miss Mupudal & Noma Magruder’s Lots, South by Mrs. M Williams & D Joiner’s land and Northwest by the road heading from Sharon to Canton] containing by estimation 368 84/100th acres be the same more or less and the said Wm. S Bailey Sheriff did advertise the same for sale according to law and the said Wm. S Bailey, Sheriff as aforesaid, on the 16th day of March AD 1846 did offer the same for sale at the Court House door aforesaid to the highest bidder for cash and Daniel Moore appeared and bid fifty dollars for said Lot which was more than any other person did or would bid. And therefore for the consideration of the aforesaid sum of fifty dollars to me in hand paid, the receipt of which is hereby acknowledged, I William S Bailey sheriff as aforesaid by virtue of the authority vested in me as sheriff do hereby bargain sell and convey to the aforesaid Daniel Moore his heirs and assigns all the rights title interest and claims of the aforesaid Ebenezer F Devine in and to the aforesaid tract or parcel of land together with all and singular the appertenances therewith belonging or in anywise appertaining to have and to hold the same forever from the said Ebenezer F Divine his heirs executors and administrators. In testimony whereof I have hereunto set my hand and official seal, the day and year first written.
