Will of Ann McWillie, Madison Co., MS, Will Book A Mississippi, Madison County June 11th, 1839 In the name of God, Amen. I, Ann McWillie of the state and county aforesaid being of sound and disposing mind and memory do make the following last will and testament. That is, I give to my son Abram A. McWillie in trust for my daughter Sarah Stover of Alabama during her natural life and after her death to the issue of her body who may be then living the following Negro slaves and their future increase, that is Jinci and children Abram, Spencer, June and Sarah. Secondly. I give to my son John McWillie during the term of his natural life and after his death to the issue of his body who may then be living the following slaves (now in his possession) that is, Bill, Rachel, Hannah, Preston, Dick, Wesley, Admiral, David, Elias, Jim, Charity and Tony. Thirdly. I give to the children of my son John who may be living at the time of my death the following Negroes and their future increase, that is Bob, Blind Polly and her children Clarissa, Synn, George and Andrew. Fourthly. I give to my son William the following Negroes, that is Spencer and his son Burgess, and Fanny and her two daughters Nancy and Hannah with their future increase. Fifthly. I give to my son Abram A. McWillie in trust for my daughter Tiszah during her natural life and after her death to the issue of her body who may then be living the following Negroes with their future increase, that is Sylvia and her three children Mynta, Caesar, and Willis, and Mynta the sister of Sylvia. The property before mentioned as given to my daughters Sarah and Tiszah is not to be subject to the debts, contracts or disposal of their present or future husbands. Sixthly. I give to my grand daughter Ann Jane Mackey during her natural life and after her death to the issue of her body who shall be then living the following Negroes, that is Paul, Louisa and her child Matilda and Alyce, Lill’s daughter with their future increase. The legal estate to said Negroes to vest in my son Abram A. as trustee as in the case of my daughters. The said property not to be subject to the debts, contracts or disposal of any husband my said grand daughter may hereafter marry. And in case my said grand daughter shall die either before or after me leaving no issue living at the time of her death, then and in that case the before mentioned property given to her I give to my daughter Margaret McCulloch during her natural life. And after her death to the issue of her body who may be then living. I give to my grand daughter Ann Jane Mackey the following Negro, that is Mana, Rachel’s daughter, with the same limitations, and on the same terms as herein before mentioned. I also give to my said grand daughter one good bed, bedstead and bed furniture. Seventhly. I give to each of my daughters one bed and bed clothes. And to them jointly all my wearing apparel, bed clothes and household items of every kind. Eighthly. I give to my son Abram A. McWillie the following Negro slaves, that is Big Harry and Little Harry; Frank; John, Polly the cook, Hannah Harry’s wife, Matilda and her children, Kitty, Martha, Polly & Wilson, Rachel and her children Mary, Georgianna & Betsey, Tom, Lucy, Cloe, Patience and Aiken during his natural life, but should my son Abram die without issue living at the time of his death then the aforesaid property is to __ and be equally divided between my children. And if any of them should be dead, their representatives. I also give to my son Abram A. my clock, household furniture except what is before given together with all the rest and residue of my estate of every description. I charge that portion of my property given to my son Abram A. with the payment of any debts which I may have at the time of my death. I constitute my son Abram A. the execution of this my last will and testament. Witness my hand and seal the day and year above written. /s/ Ann McWillie Witnessed and executed Robert Kisten, Nathaniel M__, Eliza M__ Codicil to Ann McWillie’s will Whereas I the undersigned Ann McWillie of Madison County State of Mississippi did on the 11th day of June AD 1839 make, execute and publish my last will and testament. And being now desirous of making some alterations therein and amendments thereto and additions thereto, do make ordain and publish the following said codicil to my said last will and testament (viz.). It is my will and desire, and I do hereby direct that all the property named and described in my last will and testament (except to bed dings, household linen and wearing apparel bequeathed to the legatees therein mentioned shall be held by my two sons William and Abram A. McWillie as executors and trustees in trust until all debts which may be against me remain unpaid. Furthermore as regards the bequest in my said last will and testament to my son Abram A. McWillie and contained in the clause beginning “Eighthly” I desire, will and direct that all the slaves therein mentioned with the addition of my Negro boy Burgess, the son of Spencer, and all other property therein mentioned, and all the rest and residue of my estate shall be held in possession by my son William McWillie as trustee in trust for the use and benefit of my said son Abram A. McWillie without being subject to his (the said Abram A.) disposal or liable for any debts which he may now owe or may hereafter contract in any manner, or any shape or whatever for and during the term of his (the said Abram A.) natural life. And at his death for the use and benefit of his lawful issue of the said Abram A. McWillie living at his death. But if the said Abram A. should die without leaving such then and in that case all the property and estate herein before bequeathed for his use and benefit shall go to the children of my son John McWillie and my daughter Tiszah Ann Williamson jointly and equally. And it is further my will that my son William shall have my Negro woman Lucy in the place & in lieu of my boy Burgess given in trust for the use and benefit of my son Abram A. McWillie. And it is further my will that all and every debt & debts owing by the said Abram A. McWillie to me at my death is and are hereby declared to be cancelled. I do hereby nominate and appoint my son William McWillie one of my executors.
