Will of Bunup Haley, Madison Co., MS, Will Book A In the name of Almighty God, Amen. I Bunup Haley of the County of Madison and State of Mississippi being of sound mind but weak in body and being about to leave home to travel for the recovery of my health, and considering the uncertainty of life, mine own in particular, do make and publish this my last will and testament in manner and form following, to wit. First, I do give and bequeath to my beloved wife Alice M. Haley all my real estate consisting of two eighths of land in Leake County and two eighths and a fourth in Madison County which will more fully appear by researching my land titles. Also I give and bequeath to the said Alice M. Haley all of my stock of every kind hogs, horses, oxen, cattle, sheep & carriage wagons, farming utensils & all household & kitchen. Also the following Negro slaves Mary, Betty, Bill, James, Peyton, Tempe, & Big Rachel, Alivia, and Ben nine in all. Also to the said A. M. Haley one equal half of all monies that may be collected from two certain debts due me to wit, a note of M. C. Robinson for about $3740, and one on Thomas S. Anthony now in suit in Madison Circuit Court for about $1230 originally and all other debts due to me. I give to my said beloved wife __ to enable her to pay off what I may owe together with the accounts of my present year crop which I require her to do. Second. I give and bequeath to my only daughter & child Luthe the following Negro slaves, to wit: Alfred, Delia, Miles, Emily, Jack, Little Bill, George, Betsy and Mary Ann nine in all. Also I will that she have one equal half of all monies that may be collected from the debts due me as mentioned above to wit, a note on M. C. Robinson for about $3740 and one on Thomas S. Anthony now in suit in Madison Circuit Court for about $1230 originally. And I will that all of her part of said money that may be collected together with the accounts of the labor of her said Negroes (over and above what may be expended on her education) shall be laid out for sound young Negroes for her. And in the event of said outlay not being practicable, it be put to interest in land as laid out in the best and securest manner then practicable. 3rd. And in the event of there being another child born of the said Alice M. Haley by me then I give and bequeath to said child the following Negro slaves Peyton, Tempe, Alivia, Miles, George and Mary Ann six in number being then taken from each of the above parts of my wife and child Luthe so as to make them heir equal number. That is to say six apiece. And it is my will that they heir the said __ Negroes __. Also, that the said __ should __ be one, draws an equal third part of all monies that may be made from the above mentioned two debts to wit M. C. Robinson & Thomas S. Anthony. And that the said wife and present child Luthe each an equal third parts, instead of equal halves of said debts, and that the same disposition be made of the said supposed heirs monies as is mentioned concerning Luthe’s part. Fourthly. I will and bequeath to my niece Sarah Davis now Sarah Cole the Negro girl Juba and her child James and her increase. To the said Sarah Cole & her bodily heirs, and in the event of the death of the said Sarah Cole without lawful heirs I will that said Negroes Juba & James and their increase __ to my wife Alice M. Haley to her own right and part. Fifth. Now in the event of the death of my wife or child or children as the case may be that the part of the one dying shall be combined to the other (or others equal) and in the event of the death of all of the above mentioned wife or child (children) then it is my will that the following named slaves be freed and furnished money or property to amount of one hundred dollars apiece out of my estate and be permitted to live in the county or if necessary sent to some of the free states. To wit Harry and his wife Betty; Alfred and his wife Delia; Big Rachel and child Betsy and two boys Alvin and Jack, the balance of the Negroes to be sold and the proceeds thereof together with all other assets of every kind of my estate be placed in and under the control of the trustees of the Centenary College now at the Brandon Springs, to be used by them as they may think best either principal or interest for the special support and __ of young men in indigent circumstances to complete their studies, that are regular members of the Methodist Episcopal Church giving them the preference who in the judgement of the regular faculty or trustees of said institution their __ morals & best designate them to become itinerant preachers in said Methodist Episcopal Church. Sixth. And in case of any action being necessary acceding to the fifth section of this my last will I select the Presiding Elder of the Sharon District and preacher in charge of the Madison Circuit that may then be of the M.E. Church or agent to carry out the provisions __ of the Mississippi Annual Conference of the M. E. Church. But in case of the death of my wife Alice M. Haley and __ __ child or children living to have my property or a __ I then select my old and tried friends James G. __ and John Dear Senior both or one of them as executing guardian for my heir or heirs. And I do hereby appoint my beloved wife Alice M. Haley my sole executor of this my last will and testament. Stewart An amendment made to the above will this 21st June 1843 which I wish to become part and parcel of the same, to wit: __ clause in the 4th section giving Margaret Shill [?] a conditional interest in the girl Julia and increase I hereby revoke and amend and have __ that portion therefore out of my will leaving said girl & increase to __ directly to my wife in case of the death of Sarah Cole without lawful heir or heirs or in case said Sarah Cole marries sooner than five years from the time she parted with Rueben Cole, unless sooner released by due course of law. /s/ B. I will that my Negro man Bill as he is called shall be manumitted, released from servitude as a slave and freed by due course of law from and after the twenty fifth day of December in the year one thousand eight hundred and fifty one. And I require my heirs, executors, administrators and assigns to carry out this provision & release the said Negro as above, provided the said Negro Bill or Elias shall faithfully serve me, my heirs, executors, administrators & assigns to the said time, and behave himself humbly and obediently & commit no crime forbidden by the laws of the country, nor of the authority of those having the right to control him.
