Will of Ellis P. Passmore, Madison Co., MS, Will Book A I, Ellis P Passmore, of the County of Madison and State of Mississippi being well aware of the uncertainty of human life & being at this time feeble & weak in body but of sound and disposing mind do decree and make this my last will and testament, to wit. First I direct that all my just debts be paid from my general effects in such manner as may be deemed proper and expedient by my executors. Secondly I will and direct that my entire estate both real and personal be appropriated to and divided between my wife Hester and my children equally and in accordance with the laws and statutes of the State of Mississippi and it is my special request that if possible and practicable that no sale or disposition be made of my effects for the purpose of paying debts but that the money be borrowed on mortgage or loan secured by stock on the Union Bank for said purposes, and said loans to be paid as the installments may become due from time to time by crops of cotton or otherwise as my executors may think expedient. And lastly I hereby nominate my friends Absolom Leggett and Lorenzo Latham of the County and State aforesaid executors of this my last will and testament written on two pages the fourth day of December eighteen hundred and thirty eight as witness my hand & seal. In addition to the foregoing statements and requests I hereby authorize and empower my said executors to sell transfer convey or mortgage without the intervention or interference of the laws of the state of Mississippi such of my lands or real estate as they may deem expedient and think proper for the purpose of satisfying & paying debts or otherwise giving them a full and discretionary ___ thereto.
