Will of Henry Bacon, Madison Co., MS, Will Book A I Henry Bacon of the County of Madison in the State of Mississippi being of sound disposing mind and memory do make, publish and declare this to be my last will and testament as follows: Item 1st It is my will and desire that all my just debts be paid by my executrix hereinafter named as soon as convient and practicable after my decease. Item 2nd I hereby devise and bequeath to my wife Emily J. Bacon all of the residue and remainder of my estate real, personal or mixed of which I may die seized and possessed or in any way entitled to, left after payment of my said debts & funeral and administrative expenses for and during the term of her natural life; charged however with the support, clothing, tuition and all necessary expenses of all such children as I may have living at the time of my death, up to the time of their respective marriages, majorities or deaths. Item 3rd I hereby devise and bequeath all of my said estate real, personal and mixed which shall remain at the death of my said wife to my children share and share alike and if any of them should be dead leaving descendants such descendants to have the share or shares that their ancestor or ancestors would have recieved had he, she or they been living at the death of my said wife. Item 4th I hereby nominate and appoint my said wife to be executrix of this my last will and testament and guardian of the persons and estates of my minor children and direct that she shall not be required to give bond or security as such executrix or guardian; and in case my said wife should renounce the said executrixship and guardianship or either or should be __ from discharging the duties of the same or either of them it is my will and desire that my brother Montford Bacon be executor of my said will and guardian of my said children. This day Emily Bacon widow of Henry Bacon deceased presented in Open Court a certain instrument of writing purporting to be the last will and testament of said decedent with her petition for letters testamentary thereon & on taking and reading the testamony of Dr. John G. Howard and Jacob A. Ross subscribing witnesses thereto the court after hearing and considering all the proofs and alligations adduced proposed and submitted and it being proven in open court in addition to the written affidavits of the subscribing witnesses that G. W. Edwards one of the subscribing witnesses to said instrument is dead. The Court is now fully
