Will of John G. Powell Page 311 In the name of God, amen. I John G. Powell being in feeble health but of sound and disposing mind and memory and knowing that it is appointed for all men once to die do hereby make ordain and publish this as my last will and testament hereby revoking all others by me heretofore made. Item 1 I wish all my just debts and burial expenses to be paid. Item 2 It is my will that my real and personal estate of every kind and character whatever except that hereafter and differently disposed of by this my will should belong absolutely to my brother William W. Powell, but I desire that my executor hereinafter named should cultivate my plantation in Madison County, Mississippi with the hands now upon it and pay over at the end of each year the proceeds of the crops raised thereon for the space of five years or until the said William W. Powell arrives at the age of twenty one years between my two aunts Mary F. Dudley and Sarah A. Kenedy residing in the State of Kentucky share and share alike of said proceeds to be equally divided between them, but whenever the said William W. Powell arrives at the age of twenty one years it is my will that my executor turn over and deliver to him my said plantation and all the personal property thereon including negroes, mules, horses and in fact everything upon the place. Item 3 I give and bequeath to my uncle Hobson Powell all money due or to become due me for real estate sold in the state of Kentucky and hereby direct my executor to pay over the same to him or his heirs whenever collected. Item 4 I also give and bequeath to my said uncle Hobson Powell whatever may be realized as my share from the mercantile partnership of Powell and Jeffries composed of myself and William S. Jeffries after the debts of the partnership have been paid off and discharged. Item 5 I hereby nominate and appoint my uncle George M. Powell as executor to this my last will and testament and desire that he be not required by the Probate Court to give security upon his bond as such executor. Be it remembered that a certain paper dated 18th January, 1860 and attested by James L. Meek, James McFarland and J. Warren Baughn as witnesses and purporting to be the last will and testament of John G. Powell being presented by George M. Powell in Open Court for probate and thereupon appeared in open court James L. Meek, James McFarland, and J. Warren Baughn who being duly sworn each and all of them stated that said John G. Powell at the time of death had a fixed residence in the County of Madison that the paper now offered for probate and alluded by them was signed by John G. Powell on the date thereof in the presence of each and all of said witnesses and was by him published and declared as his last will and testament and that they each and all at his request and by his direction signed their names thereto as attesting witnesses in the presence of the testator and in the presence of each other. And that at the time thereof said John G. Powell was of sound and disposing mind and memory and more than twenty one years of age. Therefore premises being considered, it is hereby ordered and adjudged said paper signed and dated and attested as aforesaid be admitted to Probate and recorded as the true last will and testament of John G. Powell deceased and that Letters Testamentary be granted to George M. Powell the executor herein named upon his entering into bond in the sum of twenty five thousand dollars, without security and all security being dispensed with in the said will.
