Will of Stephen Sutton I Stephen Sutton a citizen of the town of Nashville in the State of Tennessee being in a low state of health but of sound and disposing mind and memory do make and ordain this to be my last will and testament, to wit. Item first. I wish all my just debts & funeral expenses paid out of my estate as soon as it is convenient to be done. Item second. I give all my estate real personal or mixed of whatever kind or nature so ever it my be to my beloved wife Nancy Sutton and her heirs & assigns forever. Item third. I appoint my beloved wife Nancy Sutton sole executrix of this my last will and testament and I wish her not to be required to give any security for the execution of the same. In witness whereof I have hereunto set my hand and seal this 9th day of June AD 1838. /m/ Stephen Sutton Signed, sealed & delivered as his last will and testament by Stephen Sutton in our presence & he requested us to become subscribing witnesses. /s/ John Maties [?], John Walker, Henry Giving [?] State of Mississippi, Madison County} September term, 1837 A paper writing purporting to be the last will and testament of Stephen Sutton, dec'd was produced in Court for Probate and proved thus: Henry Giving [?] and John Maties two of the subscribing witnesses to said paper writing being first sworn dispose and say that they became such in the presence of the said Stephen Sutton and at his request in the presence of each other, and that they verily believe he was of sound & disposing mind and memory at the time he executed the same. Ordered that said paper writing be admitted to Record as such will of the said Stephen Sutton dec'd. Whereupon Nancy Sutton the executrix named in said will came into court and qualified according to law.
