DEED - Nathan Foulks to Wm. W. Tapp Transcribed and submitted by Lori Thornton 16 April 2002 Monroe County, Mississippi Deed Record 8, pp. 178-180 Nathan Foulks } This Indenture of Bargain and sale made Deed To } this 29th December 1838 between Nathan Wm W Tapp } Foulkes of the county Monroe & State of Mississippi of the first part and William W. Tapp of the county of Lowndes & State aforesaid of the second part. Witnesseth that for and in consideration of the sum of two hundred dollars to me in hand paid by the said William W. Tapp I have this day bargained sold and conveyed in full the following described tract of land to wit. the West half of the SE 1/4 of section thirty two TW N of Range 19 East situated in the N.E. Land district subject to Sale at Columbus Noxubee County Mississippi and containing eighty acres & 66/100 be the acre more or less & I do by these presents forever warrant and defend the title of the before described tract of land from my heirs or executors or administrators or assigns and I also warrant and forever defend the title of the same from all incumbrences. I also warrant the title agains the claims of all and any person claiming or pretending to claim the same to have and to hold unto the Said William T. Tapp his heirs or executors or administrators assigns forever with all and singularly the appertenances thereunto belonging. In testimony whereof I have hereunto set my hand and seal this date above written. Nathan Fowlkes [seal] The State of Mississippi} Monroe County } Personally appeared before me Charles Byram an acting Justice of the peace in and for said county do certify that Nathan Foulkes who acknowledged that he signed sealed & delivered the foregoing deed on the day & year therein mentioned for the purposes therein mentioned as his act & deed. Charles Byram [seal] Justice of the peace The State of Mississippi} Monroe County } This day personally appeared before me Charles Byram an acting Justice of peace in and for said State and county Adaann Fowlkes who acknowledged that she full of her own free will and deed does relinquish and forever quit claim to all her Right of Power to William W. Tapp to the W 1/2 half of the SE 1/4 of 32 T/W of Range 18 West. She the said Adaann Foulkes being examined separate and apart from her husband & she not being influenced by fear or threats of her said husband or anyone else. Tapp was deposited in my office for record on the 31st day of December 1838 as it appears from the endorsement therein and that the same together with the acknowledgement and ruling instrument of dower therein was well and truly recorded by me with the records of my office on the 27th day of April 1840 in Book no 8 pages 178-79 & 80.
