Foulkes & } This Indenture made at Cotton Gin his wife Deed to } Port Mississippi this the 9th day John E. Foulkes Executor} of September in the year of our Lord One Thousand Eight Hundred & Forty One between John T. Foulkes and his wife Mary Foulkes party of the first part and John E. Foulkes Executor of the Estate of Joseph Foulkes party of the second part all of the State of Mississippi Monroe County Witnesseth. that the said party of the first part for & in consideration of the sum of three hundred & fifty dollars lawful many of the United States of America to these in hand paid by the said party of the first part at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged and the said party of the second part their heirs executors & Administrators forever. Release and discharge from the said by these presents has granted bargained sold aliened [sic] remised released enfeoffed convey and confirm and by these presents do grant bargain sell alien remise released enfeoff convey and confirm unto the said paty of the second part his heirs and assigns forever all that certain piece or parcel of land lying on the west half of the North East quarter of section twelve (12) of Township No. Thirteen (13) of Range No. Nineteen (19) West included the above named half quarter (except) Twelve twenty acres on the North West corner so much thereof or the aforesaid John T. Foulks has heretofore sold unto N. A. Rayburn the remaining part containing about sixty acres more or less. Together with all and singular the tenaments hereditaments rights member privileges and appertances unto the above mentioned and described premises belonging or in any wise appertaining to have and hold the above granted and described Dower with appertances unto the said party of the second part his heirs and assigns forever and the said John T. Foulkes his wife Mary Foulkes for them and their heirs the above described and hereby granted and released premises and any part and parcel thereof with the hereditaments and appertances the said party of the second part his heirs and assigns or Executor of the Estate of Joseph Foulkes, late of said county deceased against the said party of the first part and his heirs & against all and every person & persons whomsoever lawfully claiming or to claim the Same Shall and will warrant and by these presents forever defend and I Mary Faulks wife of the aforesaid John T. Foulks for and in consideration of one dollars to me in hand paid the receipt whereof is hereby acknowledged do hereby Release and relinquish unto the said John E. Faulkes his heirs and assigns my right and letter of dower in and to the above mentioned and described land. In witness whereof the party of the first part to these presents hath hereunto Set these hands and seals the day and year first above written. John T. Vaughan a Justice of the Peace in aforesaid County and acknowledged that he signed sealed and delivered the foregoing Deed on the day and year therein to the said John E. Foulkes as his act & deed, and also appeared personally before me Mary Foulkes wife of the aforesaid John T. Foulkes who being examined privally from her husband acknowledged that She Signed Sealed and delivered the Said Deed freely and from and her own accord and without any fear Threat or compulsion of her said husband. Morgan Clerk of the Probate Monroe County } Court in aforesaid County do Certify that the within Deed was deposited in my office for Record 22nd day of November 1841.
