Hebard of the County of Monroe of the first part, Hiram N. Clarke of the County of Monroe of the second part, and David Clarke, Jerry G. Walker and William H. Walton of the County of Monroe of the third part: That whereas the said David Clarke, Jerry G. Walker, and William H. Walton did on the 2nd day of July 1851, become accommodation sureties of the said William P. Hebard on a certain promissory note of that date payable three months after the date thereof to the order of Davis and Acker for the sum of $500.00 And whereas the said William P. Hebard is anxious and desirous to endemify (sic) and save harmless the said Clarke, Walker, and Walton against all losses that may or can happen on account of this Securityship (sic) on said note, therefore in consideration of the premises as well as for and in consideration of the sum of $5.00 to the said Hebard in hand paid him by the Hiram N. Clarke the receipt whereof is hereby acknowledged. The said Hebard hath this day bargained, sold and delivered unto the said Hiram N. Clarke a fine new case of Dental Instruments and a certain Bay Horse. Upon trust nevertheless, and upon the express stipulation and agreement that the said William P. Hebard shall have quiet and peaceable possession of the said case of Dental Instruments and horse until default of payment be made in said promissory note by the said Hebard, and in any part thereof.
