The Petition of Joshua Bell shows that Tyrus Bell late of said County Deceased left five children to wit: Dudley Bell, Madison Bell, Mary Bell, John H. Bell & Tyrus C. Bell, who are now minors. That said minors are entitled as heirs at Law of said Tyrus Bell Deceased, who died leaving his Widow A. A. Bell Executrix of his last will and testament. That by the terms of said last will his Estate was to be kept together and worked and that each child was to receive their respective shares when they became of age or married. That since the death of said Tyrus, the father of said Tyrus has died leaving an Estate which descends to the children of said Tyrus as his heirs at Law. That said Estate is situated in the State of Alabama & that each child’s share will not be worth more than One Thousand Dollars. And your petitioners are advised that a Legal Guardian is necessary for the protection of said minors then that your petitioners are the brother of the said minors, that being moved by natural love and affection and anxious to secure and protect all the rights of said minors at Law, in the distribution of the Estate of said decedent, therefore pray that letters of Guardianship may be granted to them of the persons and Estate of said minors according to the Statute. And your petitioners as in duty bound will ever pray & C. Sworn and subscribed before me in open court this 24th June AD 1858 R. Ruff Probate Judge Signed J. Bell To the Honorable Reuben Ruff Judge of the Probate Court Noxubee County in the State of Mississippi. The petition of Joshua Bell shows; That by writ of inquisition of this honorable Court, Sarah Bell of said county has lately been found and adjudged to be a lunatic, and incapable of taking care of herself or her Estate. That said Sarah is in a state if hopeless and unintermitted insanity and requires constant and uninterrupted care both in the management of her person & estate. That the said Sarah is served (?) and possessed of a considerable personal estate unembarrassed (?) as your petitioners is informed and believes ??? debts, beyond the adequacy of its accruing income to meet. The said personal estate according to the estimate of your petitioners and other next of kin of said Sarah is worth (This is blank) This petition further shows that your petitioner is the brother of said Sarah and that ( several lines scratched out) the next of kin of said Sarah and is desirous of his becoming guardian of the said Sarah and her estate and that he may be invested with competent legal authority in the premises. Your Petitioner therefore prays your Honor to grant him letters of Guardianship of the person and Estate of said Sarah. And your petitioner as in duty bound &C Signed J.
