First..... I desire and direct that all my just debts be paid and to that end should there not be a sum sufficient in Ready Cash on hand after the sale of the crops to gross the present year then I direct that the following named slaves be sold in order to make up any deficit---viz. Peter, Isabel,Perry, Mary, & Eliza. Second...... That I hereby bequeath unto each of my children the sum of Two Thousand Dollars to be paid to them in money or property as they seperatelly become of age or marry Except my well beloved son William to whom I have here to fore given about said sum of Two Thousand Dollars. Third......I leave my beloved wife and faithful friend Adeline Amelia Bell Sole Executrix of this my last will directing that no security be required by the Judge of the Probate Court for her faithful fullfilment of this my last will and testament. Fourth......I leave the management and exclusive control and direction of my Estate during her widowhood to my wife, but should she marry then I direct that my Estate be equally divided between her and my children share and share alike. Fifth.....If on investigation it is fiund that William has not received Two Thousand Dollars I direct that that sum be made up to him. In the matters of a certain instrument of writing purporting to be last Will and Testament of Tyrus Bell Deceased. Be it remembered that at a term of the Probate Court of the County of Noxubee and the State of Mississippi began and held at the courthouse in and for the said County on the first Monday of May AD (1853) One Thousand Eight Hundred & Fifty Three, personally appeared in open court William D. Lyles, John W. Sudberry, & Charles Williams subscribing witnesses to a certain instrument of writing purporting to be the last will and testament of Tyrus Bell late of said county deceased bearing the date the 19 day of March1853. Who having first been duly sworn deposed and said that said Tyrus Bell signed sealed published & delivered.Said instrument as his last will and testament on the day of the date there of.That said testator was then of sound mind and memory and more than twenty one years of age and that these deponents subscribed said instruments as witnesses there to at the instance and request and in the presence of said Testator and also in the presence of each other on the the day & year aforesaid.
