Potts, against The United States. May 7, 1896 - Referred to the Committee on War Claims and ordered to be printed. Court of Claims, Clerk's Office Washington, May 6, 1896 Sir: Pursuant to the order of the court, I transmit herewith a certified copy of the findings of the fact by the court in the aforesaid cause, which case was referred to this court by the Committee on War Crimes, House of Representatives, under the Act of March 3, 1883. Amadues F. and Theophilus W. Potts v. The United States] This case, being a claim for supplies or stores alleged to have been taken by or furnished to the military forces of the United States for their use during the late war for the suppression of the rebellion, the court, on a preliminary inquiry, finds that Amadeus F. and Theophilus W. Potts, the persons alleged to have furnished such supplies or stores, or from whom the same are alleged to have been taken, were loyal to the Government of the United States throughout said war. By the Court Filed April 23, 1894 [Court of Claims. Congressional, No. 1360. A.F. and T.W. Potts v. The United States] Statement of Case The claim in the above-entitled case for supplies or stores alleged to have been taken by or furnished to the military forces of the United States for their use during the late war for the suppression of the rebellion, was transmitted to the court by the Committee on War Claims of the House of Representatives on the 24th day of February, 1887. On a preliminary inquiry the court, on the 23d day of April, 1894 found that the persons alleged to have furnished the supplies or stores, or from whom they were alleged to have been taken, were loyal to the Government of the United States throughout said war. The case was brought to a hearing on its merits on the 2d day of April, 1895. Charles F. Benjamin, esq., appeared for claimant, and the Attorney- General, by Samuel A. Putman, esq., his assistant, and under his direction, appeared for the defense and protection of the interests of the United States. The claimants, in their petition, make the following allegations: That in the year 1863 they were the owners and possessors, on their plantation in the county of Panola and State of Mississippi, of the property hereinbelow stated, which was taken by and for the use of the Army of the United States by a cavalry force under command of Colonel Hatch, as follows: 13 mules, at $180 .................................. $2,340 428 bushels corn, at $1 ............................ 428 16,800 pounds fodder, at 1 cent .................... 168 _____ Total ........................................ 2,936 The court, upon the evidence and after considering the briefs and arguments of counsel on both sides, makes the following Finding of Fact At the time and place alleged in the petition there were taken from said claimants by the military forces of the United States, for the use of the Army, stores and supplies of the general kind alleged, which at the time of taking were reasonably worth the sum of one thousand seven hundred and fifteen dollars ($1,715.00), which do not appear to have been paid for.
