Being in a Low State of Health, but of Sound mind and Knowing that it appointed for all ment to die do Mae and Constitute this my last will and Testament. My Will and Desire is that as soon as convenient, after my death that the whole of my personal property be appraised and returned by my Executors; hereafter, to be appointed to the ordinary my will and desire is that, the whole of my estate bouth real and personal shall remain in the possession of my Beloved Wife ELIZABETH WADE and for her and her use and benefit during her natural life and at her death all to sold both real and personal and the morease if any by my Executors on a credit of twelve months and that divided equally among my eight children: JOHN, WILLIAM, REBECKAH BUTLER who has married Thomas Rutler, [sic], BURNEL, HANNAH, SUSAN, HENDERSON WADE and I do appoint my Beloved Wife ELIZABETH WADE Executrix and to my two sons: William and Edward Executors of this my Last Will. Probate Court of Pontotoc County State of Mississippi The Hon. John S. Neely Judge Presiding The petition of Burnel R. Wade a citizen of said County. Represents that amount the month of February 1852 ELIZABETH WADE the mother of your petitioner, departed this life in said county, intestate, leaving in said county where she then resided, personal property undeposed of in any manner. That said property consisted of negro's thirteen or fourteen in number, and about the value of Seven Thousand Dollars. That said Elizabeth was a the time of death a femesole, and left your petitioner, JOHN WADE, WILLIAM WADE, EDWARD WADE, HENDERSON WADE, and their heirs of REBECCA BUTLER, deceased & HANNA FARMER wife of Wm. B. Farmer her only heirs, all of whom are of mature age except, the minor children of REBECCA Butler all of whom reside in Pontotoc County aforesaid, except WM Wade who resides in Dallas Co., Alabama, & EDWARD WADE in Yallobusha Co., Mississippi, and heirs of REBECCA Butler in Chickasaw Co., Mississippi. Said ELIZABETH died intestate and no administration has ever been granted on her estate so far as your petitioner is informed and believes. Your petitioner therefore prays your Honor to grant him letters of administration on the estate of said ELIZABETH on such terms and conditions as the law requires, and as shall seem meet and proper to your honor.
