Eastland Petition of Sebe Eastland in the matter of the last Will and Testament of Hi Eastland, deceased for Probate of Will and Letters Testamentary. To the Honorable J.L. McCashill Chancellor of the Chancery Court of the County of Scott in the State of Mississippi: The petition of the undersigned S. Eastland, a resident citizen of Lauderdale Co., Miss respectfully represents that Hiram Eastland late of the County of Scott aforesaid, deceased, departed this life at Forest in said County, on or about the 17th day of February A.D. 1905, leaving a last Will and Testament, duly signed, published and attested, as believed by your petitioner and which by states & which Will he in pursuance of the Statutes is wherewith presented to your Honor for Probate. That said Will is subscribed by your petitioner would represent unto your Honor that at the time of the death of the said Hiram Eastland he had his fixed place of residence in said Scott County, in the State of Mississippi as witnesses to the execution thereof That the said Will was holy written and subscribed or signed by the said Hiram Eastland and that he states to the Court that at the time of the execution of said will, which was on the 1st day of March 1900, the said testator was a man over the age of twenty-one year being at the time a widow having as his children, Eliza Earbee, Bessie Kent, Lucy Bancroft and your petitioner, and the children of William and Oliver Eastland two deceased sons of the said Hiram Eastland and a child of Laura Idom a deceased daughter. _____ of the said children of each of the said William and Oliver Eastland and Laura Idom are minors; and that the said Hiram Eastland was at the time of the execution of said Will of sound and disposing mind. Petitioner further represents and shows that said testator in said Will nominated and appointed him as the executor of said Will. Petitioner further shows that the said Hiram Eastland died seized and possessed of some real estate situated in Scott County, Mississippi, and also died seized and possessed of personal estate the last named consisting chiefly of certificates of shares & certificates of stock in different corporations, and that the value of said personal estate, according to the best information which your petitioner has been able to obtain, is about $15,000.00. Your petitioner moved by desire of meeting and fulfilling the wishes of said testator, and that his last will and testament may be in all things executed according to the true interest and meaning thereof is willing to accept and undertake the office and trust confided to him. In consideration whereof and to that end that said Will and Testament maybe performed, as aforesaid, your petitioner offers witnesses to Testify in the matter of said Will and that the probate of said Will may be thereupon granted and the same ordered for record. In consideration whereof, and to the end that said Will may be proved, established and performed, your Petitioner pray that the subscribing witnesses aforesaid may be summoned to be and appear before this Court, at the next _________Term thereof, then and there to testify in the matter of said Will, as it may please your Honor to direct; and that probate of said Will may be thereupon granted, and the same ordered for record. Bancroft & Hi Eastland whom he Believes to be amply sufficient in its provision And your Petitioner further pray that it may please your Honor to grant Him Letters Testamentary of said last Will and Testament upon his take the oath prescribed by the Statute, and entering into Bond, in such sum and with such securities as may be approved by your Honor for sureties whereof, your petitioner hereby offers Mrs. Eliza Earbee, Bessie Kent & Jefferson Kent & Lucy Bancroft & your petitioner will appoint Mounger Jones, JR McCravey & HH Watts appraisers to value and appraise the goods chattels and personal estate of said testator and make such orders as to your Honor may seem meet and proper in the premises.
