Eastland Clerk To This Indenture made and entered into this the twenty eighth Henry Dunn day of August in the year of Lord one thousand eight Wm D. Eastland hundred and forty six by and between John J Smith and R T Gatewood Margaret his wife of the County of Scott and Hugh Wm Chambers McDonald and Martha his wife of the County of Neshoba, J.M. Chambers all of the State of Mississippi of the first part and Henry Dunn, William D Eastland, Robert T Gatewood, William Chambers and John M Chambers of the second part all of the County of Scott and State aforesaid, trustees of the first Baptist Church of the town of Hillsboro in the County of Scott and State aforesaid regularly by said Church at a regular conference meeting in the Month of May AD 1844 in pursuance of an act of the Legislature of the State aforesaid passed at a regular session of the same in the year AD 1838 at Jackson in the State aforesaid, for the purpose of receiving a title to the land upon which said church is situated as herein after described in pursuance of said act of the Legislature of the State aforesaid entitled “An act granting certain power and privileges to the officers of organized religious Societies within this State Approved February the 2nd 1838 and found on page 58 of the pamplet laws printed by order of the State for said year 1838 – Witnesseth – That the said parties of the first part for and in consideration of the love and good will they have for the said first Baptist church of the Town of Hillsboro aforesaid and the sum of one dollar, and divers other good and valuable considerations to them in hand paid by the said parties of the second part Trustees as aforesaid for said Church at and before the sealing and delivery of these presents the receipt whereof is hereby forever acknowledged have this day granted, bargained sold, aliened, enfeoffed, conveyed and confirmed and by the presents do grant, bargain, sell, alien, enfeoff, convey and confirm unto the said parties of the second part Trustees as aforesaid and their successors in office forever, a certain Lot or parcel of land lying and being situated in the town of Hillsboro in said County of Scott known and designated as follows, to wit, commencing at the North East corner of the twenty acre tract upon which said town of Hillsboro is situated, according to the survey of said town and running thence due North one chain and twenty four links to a certain Stake, thence due East three chains and sixteen links, thence due South three chains and sixteen link, thence due North one chain and ninety two links to the beginning corner, being one acre square more or less, the variation of the compass in the survey of said lot or parcel of land being seven degrees and thirty five minutes East, together with all and singular the hereditaments privileges and appurtenances or in any wise thereunto appertaining. To have hold and keep forever the above described land in fee simple, for the use of the said first Baptist Church of Hillsboro as a place of Public worship and the said parties of the first part for themselves, their heirs, executors administrators and assigns do by these presents covenant, promise and agree to and with the said parties of the second part Trustees as aforesaid, and their successors in office to warrant and forever defend the title to said granted lot or parcel of land and premises, against the claim or claims of all and every claimant person or persons whether in law or equity unto the said parties of the second part Trustees as aforesaid and their successors in office as aforesaid In testimony whereof the said parties of the first part have hereunto set their hands and affixed their seals the day and year above written.
