Strong To /Trust Deed Filed for record December the 27th AD 1855 E Rush Buckner James D. Jones Clk This Indenture made the fourteenth day of April in the year of Our Lord One Thousand Eight hundred and fifty five by and between Nelson G. Strong of the first part and E. Rush Buckner as Trustee of the second part both of Scott County and State of Mississippi and Edmund Richardson & John W. Robinson Merchants & partners doing business under the name and style of Richardson & Co. at Brandon in Rankin County parties of the third part & Edmund Richardson and James Lowry Merchants & Copartners doing business under the name firm and style of Richardson Lowry & Co parties also of and with the third part as aforesaid. Witnesseth. That whereas the said party of the first part is justly indebted to the said first mentioned parties of the third part in the sum of Two Thousand Five Hundred and Ten Dollars and Eighty four cents due them from the said Nelson G Strong on the first day of January AD 1856 upon two certain promisory (sic) notes to them the said Richardson & Co. this day executed one for the sum of Fifteen Hundred and Twenty two dollars and thirty six cents, and the other for Nine Hundred and Eighty eight dollars and forty eight cents and that the said Nelson G. Strong party of the first part is also justly indebted to the said Edmund Richardson & James Lowry second parties of the third part in the sum of Four Hundred and Fifty Three Dollars and Sixty Six cents, due them upon his note to them. The said Richardson Lowry & Co. This day executed and due upon the first day of January 1856. And whereas the said Nelson G Strong party of the first part is willing and desirous to secure the said parties first and second of the third part the punctual payment of the whole of said promisory notes at maturity according to their tenor and effect: Now this indenture Witnesseth that the said party of the first part for and in consideration of the premises and also for the further consideration of the sum of Ten Dollars to him in hand paid by said E Rush Buckner party of the second part the receipt whereof is hereby acknowledged have this day sold conveyed transfered and delivered unto the said E Rush Buckner party of the second part the following described Negro slaves to wit. Nathan a boy about seventeen years old. Silas a boy about fourteen years old. George a boy about Eleven years old Jim a boy about ten years old and L____ a woman about Twenty seven years old also one good wagon running gear and boddy (sic) and three yoke of Oxen each yoke about six years old, to have and to hold to the said party of the second part upon the following specified Trust to wit – That if the said party of the first part shall pay or cause to be paid to the said first and second parties of the third part the whole of the above described promisory notes at their maturity according to Their Tenor & effect, then this conveyance shall become null and void otherwise shall remain in full force and effect and if said party of the first part shall make default in the payment of any one of said promisory notes or any part thereof at maturity then it shall be the duty of the said E Rush Buckner party of the second part upon the request of either of the said parties first or second of the Third part to expose to sale at public auction for cash before the door of the Court house of Scott County in the Town of Hillsboro the whole of the above described slaves wagon & oxen or so many or so much thereof as shall be sufficient to pay off and discharge the ballance (sic) remaining due by said party of the first part to said parties first & second of the Third part and from the proceeds of said Sale after defraying the expenses of this Trust to pay over to said first and second parties of the Third part, the ballance which may then remain due and unpaid on said promisory notes and the remainder if any, to pay over to said party of the first part. And said Trustee shall give at least twenty days previous notice of the time and place of such sale by advertisement posted up at the Court house door of Scott County and two other public places in said County and also in a newspaper printed in Brandon or Jackson. It is agreed and said party of the first part shall retain the possession of said property therein conveyed until default made in the payment of said promisory notes unless said party of the first part shall attempt to dispose of or remove any of said property before the full payment of said promisory notes and in that event the said Trustee is hereby authorized to take immediate and actual possession of all said property and retain and use the same for the purposes of this trust and said party of the first part hereby covenants to warrant and defend the title to the said Slaves Waggon and Oxen above described to the said party of the second part and his assigns forever against the claims or all persons whomsoever. Strong & E Rush Buckner, who voluntarily signed the within and foregoing Deed of Trust in my presents for the purposes therein contained. Given under my hand and seal the 14th day of April 1855 Wm A. Cabaniss the undersigned one of the acting Justices of the Peace in and for the County aforesaid personally came this day Edmund Richardson of the firm of Richardson & Co., also James Lowry of the firm of Richardson Lowry & Co., who signed the within Deed of Trust for the purposes therein contained.
