Lowry WW Lowry D.C. This Indenture made the first day of February in the year of our Lord one thousand eight hundred and fifty-five by and between Asa Chambers of the first part and Solomon M. Lowry of the second part all of the County of Scott and State of Mississippi Witnesseth; That the said party of the first part for and in consideration of the sum of two hundred and seventy seven 50/100 Dollars to him in hand paid the receipt whereof is hereby acknowledged hath granted bargained sold and confirmed and by these presents do grant bargain sell and convey unto the said Solomon M. Lowry of the first all the right title and interest in and to a certain Negro man slave for life named Daniel and aged forty five years to have and to hold the said Negro – Daniel to the said Solomon M Lowry and his heirs and assigns forever. Provided always and these presents are upon this express condition that if the said party of the first part pay to the said Solomon M. Lowry or his heirs and assigns the just and full sum of two Hundred and twenty seven 50/100 Dollars on or before the first day of January 1856 according to the condition of a certain note or writing of obligatory bearing ____ date herewith and executed by the said party of the first part to the said party of the second part then and in that case these presents shall cease determine and be null and void but in case of the nonpayment of the said sum of Two Hundred and twenty seven 50/100 Dollars then and in that case it shall and may be lawful for the said Solomon M. Lowry or his heirs and assigns and the said party of the first part do hereby empower and authorize the said party of the second part or his heirs and assigns to grant bargain and sell the above named Negro Daniel at public auction and at such sale to make and execute to the purchaser or purchasers his heirs or their heirs or assigns forever good and sufficient title in law rendering the over plus money if any to the said party of the first part his heirs executors or administrators after deducting the cost of and charges of such sale as aforesaid. Given under my hand and seal this the day and year above written Asa Chambers The State of Mississippi Scott County Personally appeared before me Wm A Lack an acting justice of the peace in and for said County Asa Chambers who acknowledged that he signed sealed and delivered the foregoing mortgage fo rthe purposes therein specified on the day and year above written Given under my hand and seal the 1st Febr 1855 Wm A.
